Sachverhalt

Kofmehl führte 61'902 kg gebrauchten, mit starker Patina versehenen Freileitungsdraht aus Kupfer, den er in der Schweiz zu Altmetallpreisen erworben hatte, nach Deutschland aus. Um gegenüber den Zollbehörden den Anschein zu erwecken, dass es sich um neue, dem Ausfuhrzolltarif nicht unterstellte Waren handle, bezeichnete er sie im Ausfuhrgesuch und in der Zolldeklaration als Kupferdraht in Ringen der Zolltarifnummer 818 b und c und setzte einen höheren Verkaufspreis ein, als mit dem deutschen Käufer vereinbart war. Da bei einer der Sendungen die unrichtige Deklaration entdeckt und festgestellt wurde, dass der Kupferdraht als Altware dem Ausfuhrzolltarif Nr. 3 (gemäss BRB vom 27. Januar 1956) unterlag, verurteilte das Eidgenössische Finanz- und Zolldepartement Kofmehl wegen Zollübertretung und Zollbannbruches zu einer Busse von Fr. 18'570.60, die dem dreifachen Betrag des hinterzogenen Zolles entsprach.

Auf Einsprache des Gebüssten bestätigte das Appellationsgericht des Kantons Basel-Stadt den Strafentscheid. Die gegen dieses Urteil eingereichte Nichtigkeitsbeschwerde wurde abgewiesen.

Erwägungen

Aus den Erwägungen:

Der Beschwerdeführer bestreitet, eine Zollübertretung und einen Bannbruch begangen zu haben, indem er geltend macht, beim ausgeführten Kupferdraht habe es sich nicht um eigentliche Altware, sondern um wieder verwendbare Nutz- oder Occasionsware gehandelt; auf diese sei Position 3 des Ausfuhrzolltarifs, die sich nur auf Altware beziehe, nicht anwendbar.

Ob eine Ware der Zollpflicht unterliegt, hängt von der Zolltarifposition ab, unter die die Ware ihrer Natur nach fällt. Der Entscheid darüber, welche Tarifposition auf eine Ware Anwendung findet, ist nach den gesetzlichen Vorschriften den Zollbehörden vorbehalten. Denn nach Art. 111 Abs. 1 ZG wird die Festsetzung des geschuldeten Zollbetrages durch die zuständige Zollbehörde, letztinstanzlich durch die Zollrekurskommission, endgültig entschieden, und gemäss Art. 101 Abs. 3 ZG dient der rechtskräftige Zollansatz, der von der Zollbehörde vorgängig einer administrativen Strafverfügung zu bestimmen ist, als Grundlage für die administrative und richterliche Strafzumessung. Die Bestimmung des dem geschuldeten Zollbetrag zugrunde liegenden Zollansatzes aber ist gleichbedeutend mit der Einreihung der Ware unter eine bestimmte Tarifposition; diese bestimmt den Zollansatz und umgekehrt. Mit der rechtskräftigen Festsetzung des Zollansatzes, die nach Art. 101 Abs. 3 ZG auch den Strafrichter bindet, ist daher auch die Frage der anwendbaren Zolltarifposition und damit insoweit zugleich über die Zollpflicht verbindlich entschieden. Die Einreihung des Kupferdrahtes unter Nr. 3 des Zolltarifs, gegen die dem Beschwerdeführer der verwaltungsrechtliche Beschwerdeweg wegen unrichtiger Festsetzung des Zollbetrages (Art. 109 ff. ZG) offen stand, wovon er aber keinen Gebrauch gemacht hat, kann infolgedessen vor dem Strafrichter nicht mehr angefochten werden. Im gleichen Sinne hat der Kassationshof am 25. März 1960 i.S. Yassine (Erw. II Ziff. 1) entschieden.
