In debt enforcement proceedings brought by R. & Cie. against X., the enforcement office attached CHF 500 per month from the debtor’s income as a naturopath. The cantonal supervisory authority set aside the attachment, holding that a share of income from self-employed liberal-profession work could not be attached. On appeal, the Federal Supreme Court held that Art. 93 SchKG also covers income from independent activity. In der Betreibung, welche die Firma R. & Cie gegen X. führt, pfändete das Betreibungsamt Heiden am 28. November 1959 vom selbständigen Erwerb, den der Schuldner als Naturarzt erzielt und den es auf netto Fr. 15'000.-- pro Jahr schätzte, den Betrag von Fr. 500.-- pro Monat. Auf Beschwerde des Schuldners hat die kantonale Aufsichtsbehörde diese Pfändung mit Entscheid vom 11. Februar 1960 aufgehoben, weil das Gesetz die Pfändung eines Teils des Gesamterwerbs aus freier Berufstätigkeit nicht gestatte. Diesen Entscheid hat die Gläubigerin an das Bundesgericht weitergezogen.

Erwägungen

Die Schuldbetreibungs- und Konkurskammer zieht in Erwägung:

Nach den Entscheiden BGE 84 IV 155 ff. und BGE 85 III 38 ff., welche die Vorinstanz übersehen hat, lässt Art. 93 SchKG die Pfändung des Arbeitseinkommens des Schuldners ohne Rücksicht darauf zu, ob es aus unselbständiger oder selbständiger Berufstätigkeit herrühre. Gleich wie die Einkünfte aus dem Betrieb eines Schönheitssalons oder einer Autofahrschule, auf welche die erwähnten Präjudizien sich beziehen, sind also nach Art. 93 SchKG auch die Honorareinnahmen eines Naturarztes aus der Behandlung von Patienten pfändbar, soweit sie den Notbedarf des Schuldners und die zu ihrer Erzielung notwendigen Auslagen (Gestehungskosten) übersteigen. Wenn aus den Akten nicht ersichtlich ist, wieviel der Schuldner unter diesem Titel einnimmt, so ist dies kein Grund, von einer Pfändung abzusehen. Vielmehr ist zu prüfen und nötigenfalls zu schätzen, wie hoch die Honorareinnahmen des Schuldners und die von ihm aufzuwendenden Gestehungskosten sich belaufen. Einen Anhaltspunkt kann dabei der Umstand bieten, dass der Schuldner bei einem Umsatz von rund Fr. 31'000.-- nur für rund Fr. 4500.-- Heilmittel eingekauft hat. Beim Entscheid darüber, welcher Teilbetrag des so errechneten Nettoeinkommens aus der Berufstätigkeit des Schuldners gepfändet werden könne, ist auf das Einkommen Rücksicht zu nehmen, dass der Schuldner nicht durch solche Tätigkeit, sondern anderswie erzielt. Soweit der Schuldner seinen Notbedarf aus anderweitigen Einkünften bestreiten kann, ist er zu dessen Deckung nicht auf sein Arbeitseinkommen angewiesen.

Dispositiv

Demnach erkennt die Schuldbetr.- u. Konkurskammer:

Der Rekurs wird dahin gutgeheissen, dass der angefochtene Entscheid aufgehoben und die Sache zur Bestimmung des allenfalls pfändbaren Einkommens an die Vorinstanz zurückgewiesen wird.
