The Federal Court dismissed the defendant’s cassation complaint. It held that the concept of support under Art. 201(1) StGB is broad and covers all necessities of life, not only food and clothing. The defendant lived substantially from his wife’s prostitution earnings, which paid for the apartment, household equipment, car and most family expenses. The marital separation of property did not alter the husband’s primary duty to provide for himself, his wife and child. Die Behauptung des Beschwerdeführers, dass er seinen eigenen Unterhalt nie, auch nicht teilweise, aus dem unsittlichen Erwerb seiner Ehefrau gedeckt habe, trifft nicht zu. Zum Unterhalt gehören nicht nur Nahrung und Kleidung, sondern alles, was jemand zum Leben benötigt, also auch Wohnung, Gesundheitspflege, Erholung und die Befriedigung anderer Bedürfnisse. Die Ausstattung der ehelichen Wohnung mit Möbeln, Radio, Teppichen usw. und die Anschaffung eines Autos, das wie die Wohnungseinrichtung auch vom Beschwerdeführer benützt wurde, finanzierte ausschliesslich dessen Ehefrau aus den Einkünften ihres unsittlichen Gewerbes, aus denen sie ausserdem den grössten Teil des Unterhalts des Kindes und der Kosten des gemeinsamen Haushaltes bestritt (namentlich Miete, Telephon, Gas, Elektrisch, usw.). Der Beschwerdeführer hat sich somit zu einem erheblichen Teil im Sinne von Art. 201 Abs. 1 StGB aus dem unsittlichen Erwerb seiner Ehefrau unterhalten lassen. Daran ändert nichts, dass zwischen den Ehegatten auf Grund eines Ehevertrages Gütertrennung besteht, die Ehefrau demzufolge güterrechtlich über ihr Vermögen und ihren Arbeitserwerb selbständig verfügen kann und an die ehelichen Lasten einen angemessenen Beitrag zu leisten hat (Art. 242, 246 ZGB). Die allgemeinen Wirrkungen der Ehe, insbesondere die in Art. 160 ZGB dem arbeitsfähigen Ehemann auferlegte Pflicht, für den eigenen Unterhalt und denjenigen von Frau und Kind in erster Linie selber aufzukommen, werden durch die Art des ehelichen Güterstandes nicht berührt.

Statt pflichtgemäss den lebensnotwendigen Bedarf der Familie durch ehrlichen Arbeitserwerb sicherzustellen, zog es der Beschwerdeführer vor, zweifelhaften Geschäften mit unsicherem Einkommen nachzugehen, wohl wissend, dass seine Ehefrau für den Unterhalt seiner Familie sorge. Sein Einwand, dass es nur deshalb dazu gekommen sei, weil seine Ehefrau sich mit einer seinem Einkommen entsprechenden einfachen Lebensführung nicht begnügt und gleichsam gegen seinen Willen eine höhere Lebenshaltung durchgesetzt habe, hilft nicht. Der Beschwerdeführer wusste, dass seine Ehefrau die hohen Beiträge nur auf dem Wege der gewerbsmässigen Unzucht zu leisten imstande war, und gegen diese verwerfliche Art des Gelderwerbes hätte er einschreiten können und müssen. Dass er das deswegen nicht tat, weil er nicht wollte, ergibt sich daraus, dass er das luxuriöse Leben seiner Ehefrau teilte, diese bei der Ausübung ihres Gewerbes gewähren liess, ja sogar, wie die Vorinstanz feststellt, zur Unzucht anhielt. Das Merkmal der Ausbeutung nach Art. 201 Abs. 1 StGB ist damit in ausgeprägter Form erfüllt.
