Resumo Omnilex

Motta was convicted in Zurich for forgery after handing his lawyer three false letters to use as evidence in a damages action against H. On cassation, he argued that no unlawful advantage was sought because the civil claim was allegedly well founded. The court dismissed the argument and held that a person may not fabricate documents to improve the evidentiary position in civil litigation, even if the underlying substantive claim may be valid. The appeal was dismissed and the conviction remained in force.

Sumário Omnilex

Art. 251 StGB; forgery committed in order to support a civil claim constitutes pursuit of an unlawful advantage even if the underlying claim may be well founded. A litigant who cannot prove his right by lawful means must bear the consequences of failed proof; he may not create false documents to alter the evidentiary situation in his favour. The decisive element is the prohibited manipulation of proof and the resulting impairment of reliable adjudication, not the material validity of the disputed claim (consid. ...).

Urteilskopf

83 IV 81

  1. Auszug aus dem Urteil des Kassationshofes vom 5. April 1957 i.S. Motta gegen Staatsanwaltschaft des Kantons Zürich.

Sachverhalt

I. Exp.Kom. 2, 116, Votum v. Schumacher). I. Exp.Kom. 2, 118, Voten Weber und Stooss), was in der Folge unwidersprochen blieb.

Whether a forged document prepared to support a supposedly valid civil claim still pursues an unlawful advantage under forgery law.

Decisão extraída

Yes. A party who cannot prove a claim with lawful means may not falsify documents to improve his prospects in civil litigation; the advantage sought is unlawful regardless of whether the underlying claim is materially justified.

Fundamentação extraída

The court rejected the view that a forgery is lawful when used only to obtain satisfaction of a valid claim. It held that civil litigants must bear the consequences of failing to prove their case lawfully. Creating false documents to alter the evidentiary position undermines the state's interest in reliable adjudication and therefore constitutes an unlawful advantage.
