Questão jurídica principal
Whether a suspended sentence must be executed when the offender commits a new intentional felony or misdemeanor during probation and again receives a suspended sentence for the new offense.
Decisão extraída
Yes. Execution of the earlier suspended sentence remains mandatory even if the new offense also results in a suspended sentence.
Fundamentação extraída
The 1950 revision of the Criminal Code did not change the rule requiring execution in such cases. It only allowed, in particularly slight cases, replacement measures under Art. 41 ch. 3 para. 2 StGB. Where that exception does not apply, the legislature deliberately kept the mandatory character of Art. 41 ch. 3 para. 1, so there is no gap for the judge to fill.
