Resumo Omnilex

The court held that, in composition liquidation proceedings, a creditor committee’s refusal to admit assets (Admassierung) may be challenged by complaint. It approved the lower court’s view and reasoned that there is no basis for treating such decisions differently from comparable orders issued by the bankruptcy office in bankruptcy proceedings, which are open to complaint by any creditor under established practice.

Sumário Omnilex

Complaint against a creditor committee’s refusal to order inclusion of assets in composition liquidation; such refusal is subject to complaint. In the absence of any reason for differentiation, decisions of the creditor committee in Nachlassliquidation are to be treated like comparable measures of the bankruptcy office in bankruptcy proceedings, which any creditor may attack by complaint (cf. BGE 64 III 36; consid. 1).
