The Federal Court dismissed X.’s constitutional complaint against Baselland. It held that a canton may condition admission to legal practice not only on possession of a cantonal bar patent but also on personal suitability, and may decide that question independently, even considering conduct occurring outside its territory. The fact that Solothurn had only issued a warning did not prevent Baselland from withdrawing the practice licence. The assessment of these personal prerequisites belongs independently to each canton, which may also rely on facts occurring outside its territory insofar as they are relevant to the applicant’s reliability (consid. 2). Withdrawal of the practice licence in several cantons for the same conduct is not objectionable under constitutional law, since the measure is not a criminal sanction but an administrative act whose effects are territorially confined; the principle ne bis in idem is therefore inapplicable (consid. 3).

III. AUSÜBUNG DER 'VISSENSCHAFTLICHEN BERUFSARTEN EXERCICE DES PROFESSIONS LffiERALES 4. Auszug a.us dem Urteil vom 26. Februar 1927 i. S. X. gegen Baselland. A n wal t, Art. 5 Ueb.-Best. z. BV : Befugnis der Kantone, die Bewilligung zur Ausübung des Anwaltsberufes ausser an den Besitz eines kantonalen Anwaltspatents auch an persönliche Voraussetzungen zu knüpfen. -Die Bewilligung kann bei Wegfall dieser Voraussetzungen von jedem Kanton selbständig, auch wegen Vorkomm- nissen, die sich ausserhalb seines Gebiets abspielten, ent- zogen werden. A. -Der Rekurrent besitzt das solothurnische Für- sprecherpatent und wurde gemäss Art.' 5 Ueb.-Best. z. BV auch in Basel-Stadt und -Land zur Berufsausübung zugelassen. Auf Beschwerde eines Klienten wurde ihm in diesen beiden Kantonen die Bewilligung auf bestimmte Zeit entzogen, während Solothurn es mit einem Verweis bewenden liess. B. -Gegen den Entzug der Berufsausübungsbewilli- gung erhob der Rekurrent staatsrechtliche Beschwerde u. a. deshalb, weil nur Solothurn zur Disziplinierung zuständig gewesen sei. Das Bundesgericht wies die Beschwerde (gegenüber Basel-Land) ab mit der Begrün- dung: Der Rekurrent kann, nachdem er die Kompetenz des Obergerichts von Basel-Land zur Beurteilung der gegen ihn erhobenen Disziplinarbeschwerde ausdrück- lich anerkannt hat, im staatsrechtlichen Verfahren nicht mehr darauf zurückzukommen. Im übrigen wäre die Inkompetenzeinrede nicht begründet. Art. 5 Ueb.-Best. z. BV gibt dem Inhaber eines kantonalen Anwalts- patentes das Recht zur Ausübung des Anwaltsberufes Ausübung der wissenschaftlichen Berufsarten. N° 4. 29 in andern Kantonen nur in dem Sinn. dass dort keine weitern Ausweise über die berufliche Eignung verlangt werden dürfen. Dagegen steht es jedem Kanton frei, die Bewilligung zur Ausübung des Anwaltsberufes ausser an den Ausweis über die berufliche (den Besitz eines Anwaltspatentes) auch an denjenigen über die persön- liche Eignung zu knüpfen (BGE 41 I S. 388). Über das Vorliegen der persönlichen Voraussetzungen hat nun aber jeder Kanton selbständig zu entscheiden (BGE 41 I 388). Er ist dabei befugt, auch solche Tatsachen zu berücksichtigen, die sich ausserhalb des Kantons- gebietes abspielten, sofern sie für die einzig massgebliche Frage. ob der betreffende Anwalt das Vertrauen ver- diene, das ihm notwendig entgegengebracht werden muss, von Bedeutung sind (BGE 26 I 81). Wer dieses Vertrauen nicht verdient, braucht in keinem Kanton zur Anwaltsprax.is zugelassen zu werden. Der Entzug der Berufsausübungsbewilligung in mehreren Kantonen . zugleich wegen einer und derselben Handlung ist deshalb staatsrechtlich nicht anfechtbar. Insbesondere verstösst sie, da es sich nicht um eine Strafe, sondern um eine in ihren Wirkungen auf das Kantonsgebiet beschränkte Verwaltungsmassnahme handelt, nicht gegen den Grund- satz ne bis in idem.
