Haueter challenged a Lucerne bill-of-exchange enforcement, arguing that Lucerne had not validly been designated as domicile and that he retained his constitutional forum of residence. The Federal Court accepted the complaint. It found that the alleged later addition of the Lucerne domicile clause had not been proven and that the handwritten addition by Haueter did not clearly amount to an unconditional acceptance of Lucerne jurisdiction. Because a waiver of the constitutional forum cannot be presumed, the Lucerne exchange rules on deposit and local jurisdiction could not be applied against him. The cantonal decision and the enforcement proceedings were therefore annulled.
Art. 59 BV; waiver of the constitutional forum in bill-of-exchange matters; special domicile clause and burden of proof. A debtor subject to a bill of exchange is bound by a cantonal special forum only if the instrument clearly designates the forum or domicile and the waiver of the ordinary forum is unequivocal. Where the alleged domicile clause was added after acceptance and such alteration is not proven, or where the debtor's wording leaves doubt as to an unconditional submission, no renunciation of the constitutional forum may be inferred. In case of doubt, the home forum remains protected; cantonal rules on deposit of the bill amount and local enforcement cannot apply without valid submission (consid. 1-3).
des Rekurrenten, der Wechsel sei nicht in Luzern domizilirt, sei, wie sich aus dem Wechsel ergebe, unrichtig. Der Domizilvermerk zahlbar bei der Kreditanstalt Luzern sei nicht erst nach der Acceptation zugefügt worden und der Zusatz des Haueter sei kein Domizilvermerk, derselbe habe keinen Sinn und keine Bedeu tung, weil die Unterschrift mangle. Durch das Wechselaccept habe sich Rekurrent den Gesetzen des Kantons Luzern unterworfen und es kommen namentlich in Betracht die 23, 24 und 96 der dortigen Wechselordnung, auf welchen der angefochtene Ent scheid beruhe. Uebrigens habe Rekurrent sich auch des Rechtes begeben, der Exekution zu widersprechen, indem er unterlassen habe, bei seiner Einwendung den Betrag der Wechselforderung zu deponiren, beziehungsweise um Entbindung dieser Verpflich tung nachzusuchen.
