Kuhn sued Wartime Co A.-G. for CHF 1,653, and Wartime Co A.-G. counterclaimed for CHF 20,000 or an amount to be fixed by the court. The cantonal courts upheld the main claim and dismissed the counterclaim. When Wartime Co A.-G. appealed to the Federal Court, the Court held that the value of the counterclaim could not be combined with the main claim and that the appellant had to indicate whether the counterclaim, as still disputed before the cantonal appellate court, reached the federal appeal threshold. Prozessrecbt. No 61. VI. PROZESSRECHT PROCEDURE 61. Urteil der I. Zivilabteilung vom 16. Oktober 1922 i. S. Wartime Co A.-G. gegen Ituhn. Berufung, Form: Angabe des Streitwerts vor Bundes- gericht. Eine solche ist notwendig, wenn eine Partei vor der letzten kantonalen Instanz eine Forderung ge- stellt hatte, deren Höhe sie voHständig dem richterJichen Ermessen überliess. A. -Am 30. März 1920 hat der Kläger Kuhn beim Richteramt Solothurn-Lebern Klage erhoben, mit dem Rechtsbegehren, die Beklagte Wartime Co A.-G. habe ihm 1653 Fr. nebst 6 % Zins seit 26. Februar 1920 zu bezahlen. B. -Die Beklagte hat iderklageweise das Rechts- begehren gestellt, der Kläger und Widerbeklagte habe an sie einen Betrag von 20,000 Fr., eventuell eine vom Gericht zu bestimmende Summe, nebst 6 % Zins seit 5. Mai 1920 zu bezahlen. C. -Das Amtsgericht Solothurn-Lebern hat durch Urteil vom

  1. September 1921 die Klage im Betrage von 1598 Fr. nebst 6 % Zins seit dem 26. Februar 1920 gutgeheissen und die Widerklage gänzlich abgewiesen. D. -Vor dem solothurnischen Obergericht, an das die Beklagte appellierte, stellten die Parteien folgende Anträge; .
  2. Die Beklagte: Das Klagebegehren sei abzuweisen und das Widerklagebegehren in einer Höhe nach richter- lichem Ermessen zuzusprechen. )
  3. Der Kläger: (I Das Urteil des Amtsgerichts Solo- thurn-Lebern sei zu bestätigen. E. -Mit Urteil vom 25. Januar 1922 hat das Ober- ProZ8ssrecht. N 61. 4.) I gericht des Kantons .Solothurn da ; amtsgerichUiche Urteil bestätigt. F. -Gegen das Urteil des Obergerichts hat die Beklagte und Widerklägerin die Berufung an das Bundes- gericht erklärt, mit den Anträgen:
  4. Das Klagebegehren sei abzuweisen, eventuell sei von der Klageforderung ein Betrag nach Ermessen des Gerichts abzuweisen, und der eventuell zugesprochene Betrag mit der Widerklageforderung zu verrechnen.
  5. Das Widerklagebegehren sei gutzuheissen. Das Bundesgericht zieM in Erwägung: Da mit der Hauptklage nur ein Betrag von 1653 Fr. bezw. 1598 Fr. gefordert wird, und nach Art. 60 Abs.2 OG bei Bestimmung des Streitwerts im Berufungs- verfahren der Betrag einer Widerklage nicht mit dem- jenigen der Hauptklage zusammengerechnet werden darf, hängt die Zulässigkeit der Berufung davon ab, ob das Widerklagebegehren an sich einen Streitwert von wenigstens 4000 Fr. aufweise. Hiefür ist nach Art. 59 Abs. 1 OG entscheidend, in welchem Umfange dieses Rechtsbegehren vor der oberen kantonalen Instanz noch streitig war. Nun hat die Beklagte und Wider- klägerin vor Obergericht die Bezifferung der ihr zuzu- sprechenden Summe vollständig in das richterliche Ermessen gestellt, ohne weder einen Höchst-noch einen findestbetrag zu nennen. Nach Art. 63 Ziff. 1 OG und der Auslegung, welche das Bundesgericht dieser Bestimmung gegeben hat (vgl. BGE 47 II S. 224), war aber die Beklagte zur Angabe, ob der geforderte Höchst- betrag mindestens 4000 Fr. erreiche, verpflichtet. Die Nichtbeobachtung dieser Vorschrift zieht nach ständiger Praxis die Unwirksamkeit der Berufung nach sich. Demnach erkennt das Bundesgericht: Auf die Berufung wird nicht eingetreten.
