In a circular dated 20 October 1917, the Federal Supreme Court informed cantonal supervisory authorities that pledge holders must, in bankruptcy movables auctions, receive a separate notice stating the place and time of the auction. The circular instructs cantonal bankruptcy offices to comply with this practice in future cases.
In bankruptcy liquidation auctions of movables, pledge holders are entitled to a special notice specifying the place and time of the auction; this notification is required in ordinary as well as summary bankruptcy proceedings. The supervisory authorities and bankruptcy offices must ensure compliance with this duty of notification (cf. prior chamber decision referenced in the circular).
