Eva Förtsch sought annulment of Bern’s decision refusing to lift her 1872 expulsion from the canton and to permit her residence there, invoking Art. 2 of the Swiss–German settlement treaty. The Bernese Government argued that the matter was an administrative dispute concerning a treaty on settlement and therefore fell outside the Federal Supreme Court’s competence. The Federal Supreme Court agreed and did not enter into the complaint, leaving the petitioner to apply to the Federal Council.
Art. 59 Ziff. 10 Bundesgesetz über die Organisation der Bundesrechtspflege vom 27. Juni 1874; competence for disputes based on treaty provisions concerning settlement and residence. Complaints founded on such international treaty norms are to be treated as administrative matters and are not cognizable by the Federal Supreme Court; jurisdiction lies with the Federal Council, respectively the Federal Assembly. Where the objection of incompetence is well founded, the court issues a non-entry decision without examining the merits (consid. 1).
Auslande, welche die Niederlassung betreffen, stütze und mithin durch Art. 59 Ziffer 10 des Bundesgesetzes über die Organi sation der Bundesrechtspflege vom 27. Juni 1874 als eine Ad ministrativsache dem Bundesrathe, beziehungsweise der Bundes versammlung zur Erledigung zugewiesen sei. Demnach hat das Bundesgericht, in Anwendung des von dem Regierungsrathe des Kantons Bern richtig angerufenen Art. 59 lemma 2 Ziffer 10 des Bundesge setzes vom 27. Juni 1874, erkannt: Auf die vorliegende Beschwerde wird hierorts wegen Inkom petenz nicht eingetreten und der Petentin überlassen, sich an den Bundesrath zu wenden.
