  1. Urtheil vom 7. Dezember 1878 in Sachen Bank in Winterthur. A. Mit Eingabe vom 28. Oktober d. J. beschwerte sich die Bank in Winterthur über einen Entscheid des Regierungsrathes des Kantons Zürich vom 31. August d. Jahres, durch welchen sie verpflichtet worden, an die Stadt Winterthur neben dem für Staats- und Gemeindesteuern mit Fr. 2,000,000 taxirten Re servefond auch von den auf Fr. 390,000 taxirten Liegenschaften die Gemeindesteuern zu bezahlen. Sie behauptete, dieser Beschluß beruhe nicht bloß auf einer unrichtigen Auslegung des zürche rischen Gemeindegesetzes, sondern begründe auch eine nach Art. 46 der Bundesverfassung unzulässige Doppelbesteuerung, gegen welche das Bundesgericht Schutz zu gewähren habe. B. Der Regierungsrath des Kantons Zürich trug unter Hin weisung auf die Begründung des unterm 26. Mai 1877 vom Bundesgerichte in Sachen der Bad- und Waschanstalt Winter thur erlassenen Entscheides auf Abweisung der Beschwerde an. Das Bundesgericht zieht in Erwägung: Die vorliegende Beschwerde stützt sich lediglich darauf, daß der angefochtene Beschluß eine unzulässige Doppelbesteuerung in volvire. Allein eine bundesrechtswidrige Doppelbesteuerung, ge gen welche allein das Bundesgericht seine Intervention eintreten lassen könnte, liegt, wie schon in einer Reihe von Entscheidun gen ausgesprochen worden (vergleiche amtliche Sammlung der bundesgerichtlichen Entscheidungen Bd. I. S. 51 Erwäg. S. 59 Erwg. 2, S. 66 Erwg. 3, Bd. II. S. 187 Erwg. 1, S. 385 Erwg. 2 u. s. w.), nur vor, wenn die Steuergesetzgebun gen zweier oder mehrerer Kantone auf die Besteuerung des gleichen Objektes Anspruch machen und somit ein inter kantonaler Konflikt vorhanden ist. Im vorliegenden Falle handelt es sich aber ausschließlich um die Anwendung eines zürcherischen Gesetzes auf die im Kanton Zürich domizilirte Re

kurrentin und mangelt daher dem Bundesgerichte die Kompe tenz, auf die Beschwerde einzutreten. Demnach hat das Bundesgericht erkannt: Die Beschwerde wird wegen Inkompetenz von der Hand ge wiesen.
