The appellants attacked a will before the Lucerne courts, arguing that it was invalid because the guardian had not participated in its execution. The Lucerne Court of Appeal held that the formal defect existed but did not justify invalidity in the circumstances. On federal recourse, the appellants invoked Art. 4 BV and claimed the cantonal court had decided contrary to the clear wording of the law. The Federal Court held that this complaint was itself an extraordinary ground for cassation under Lucerne ZPO Arts. 263 no. 3 and 271, so the appellants first had to seek the cantonal cassation remedy. The recourse was therefore not admitted.
Art. 4 BV; exhaustion of cantonal remedies where a party alleges judgment against the clear wording of the law; in the Canton of Lucerne, such a complaint constitutes an extraordinary cassation ground under Arts. 263 no. 3 and 271 ZPO. The Federal Court will not entertain a recourse for arbitrariness or manifest statutory misapplication if the available cantonal cassation complaint has not been used. The requirement of exhaustion applies even when the challenged judgment is a cantonal appellate decision and the alleged defect concerns the disregard of an allegedly unambiguous statutory text.
überall da, wo behördliche Willkür sich an Stelle der gesetz lichen Regel zu setzen unternimmt; überall da, wo das Gesetz in mit seinem Wortlaut, Sinn und Zweck offensichtlich nicht vereinbarer Weise ausgelegt wird; überall da, wo ein Urteil der sonstigen Praxis diametral entgegensteht. C. Das Obergericht des Kanions Luzern hat Abweisung des Rekurses beantragt; ebenso die Rekursbeklagten. Das Bundesgericht zieht in Erwägung: Die Rekurrenten beschweren sich darüber, daß gegen den klaren, unzweideutigen Buchstaben eines Gesetzes geurteilt worden sei. Nun ist aber dies ein außerordentlicher Kassationsgrund im Sinne von 263 der luzernischen ZPO, welcher lautet: Außerordentlicherweise findet eine Kassation statt: .... 3. wenn gegen den klaren, unzweideutigen Buchstaben eines Gesetzes geurteilt wurde. Hienach (vergl. auch 271 ZPO, welcher speziell die Kassa tion obergerichtlicher Urteile vorsieht) hätte also im vorliegenden Falle gegen das angefochtene Urteil noch ein kantonales Rechts mittel ergriffen werden können. Es ist daher (vergl. Urteil des Bundesgerichts vom 10. Februar 1909 in Sachen Bucher Durrer gegen Berchtold, Erw. 1 ) wegen Nichterschöpfung des kantonalen Instanzenzuges auf die Beschwerde nicht einzutreten.
