The Federal Court held that an enforcement proceeding brought directly against a married woman living in community of property is void under Art. 47 SchKG if the payment order and related documents are not directed to the husband as legal representative; postal delivery to the husband does not suffice where he receives them only as a household member. By contrast, although the seizure of the wife’s property claim during community of property may have conflicted with cantonal matrimonial property law, an unchallenged seizure need not be annulled ex officio. The appeal was therefore only partly successful: Halff’s enforcement remained void, while Spieß’s seizure was allowed to stand.
Art. 47 SchKG; direct enforcement against a wife living in matrimonial community through omission of service to the husband as legal representative renders the proceeding absolutely void and subject to ex officio annulment. Service to the husband cures nothing where the payment order is framed as if the wife were directly amenable to enforcement and the husband receives the documents only as a household addressee under Art. 64 SchKG. By contrast, a seizure of a wife’s claim made in violation of cantonal matrimonial property rules is not, for that reason alone, null and void; if not timely challenged, it need not be set aside ex officio, because the lack of admissibility does not entail the absence of any compulsory enforcement interest (consid. 1–2).
Zur Begründung führt hier die Vorinstanz aus: Zur Zeit dieser Pfändung (18. Oktober 1907) habe Gütergemeinschaft zwischen den Eheleuten Rittmann bestanden und sei also eine Pfändung des Frauengutes unzulässig gewesen (Archiv 10 Nr. 16). Die vorgenommene Pfändung müsse deshalb, weil dem ehelichen Güterrecht widersprechend, aufgehoben werden. D. Diesen Entscheid haben nunmehr die Gläubiger E. Spieß und M. Halff rechtzeitig an das Bundesgericht weitergezogen, der erste mit dem Antrage, die Pfändung vom 18. Oktober für seine Betreibung, der zweite mit dem Antrage, seine ganze Betreibung, samt seiner Pfändung vom 18. Oktober als rechtsgültig zu er klären. Spieß macht geltend, daß eine Aufhebung der unangefochten gebliebenen Pfändung von Amtes wegen sich nicht rechtfertigte; Halff ebenso und im weitern, daß dem Art. 47 durch Zustellung der Betreibungsurkunden an den Ehemann, den gesetzlichen Ver treter der Schuldnerin, Genüge geleistet sei. Die Vorinstanz hat von Gegenbemerkungen zum Rekurse ab gesehen, der Gläubiger Weiß beantragt dessen Abweisung. Die Schuldbetreibungs und Konkurskammer zieht in Erwägung:
