Resumo Omnilex

Giequel challenged a judgment of the Uri district court by filing a state-law appeal to the Federal Court. The submission was not signed. The Federal Court held that a signature by the appellant or an authorized representative is an essential formal requirement of an appeal petition; without it, the filing is not a legally relevant act. The court therefore refused to enter into the appeal.

A recourse petition must be signed by the appellant or his authorized representative. An unsigned filing is not a legally relevant declaration and cannot trigger appellate review; the court must decline to enter into the appeal (consid. 1–2).

Texto completo

  1. Urteil vom 5. November 1903 in Sachen Giequel gegen Kreisgericht Uri. Form des staatsrechtl. Rekurses. Unterzeichnung. Art. 175 Ziff. 3 Org.-Ges. Das Bundesgericht hat in Erwägung:
  2. Daß die von Giequel eingesandte Eingabe, worin über ein Urteil des Kreisgerichts Uri vom 3. August 1903 Beschwerde geführt wird, nicht unterzeichnet ist;
