The creditors sold a pocket watch to Johann Meister with a reservation of title and later sought seizure for the unpaid balance. A pocket watch is, in modern conditions, a necessary object for a laborer, including an agricultural laborer, since it serves the accurate observance and division of working time and the proper performance of occupational duties. The exemption from seizure depends on the object's function and need, not on its ownership structure. The possibility of substitution by a simpler object exists only where the seized item is of clearly superior value and the procedural prerequisites for exchange are met (consid. 1).
Landarbeiter, als ein unentbehrlicher Gegenstand im Sinne des Art. 92 des Betreibungsgesetzes sich darstellt, als ein Objekt, dessen er zu einer genauen Innehaltung und Einteilung seiner Arbeitszeit und damit zu einer richtigen Erfüllung seiner beruflichen Obliegenheiten dringend bedarf (vergl. auch Archiv V, Nr. 87 id Zeitschrift für handelsrechtliche Entscheidungen, Bd. XVII, 134). Es könnte sich also nur noch fragen, ob die gepfändete Ihr von besserer Qualität sei und deshalb den Rekurrenten die Befugnis zustehe, sie durch eine einfachere, von geringerem Werte zu ersetzen. Abgesehen aber davon, daß ein bezügliches Beschwerde begehren nicht vorliegt, wird das gepfändete Objekt im vorinstanz lichen Entscheide auf nur 15 Fr. veranschlagt, so daß offenbar die Voraussetzungen zu einem solchen Austausch nicht vorhanden sind. Ganz unerheblich für die hier streitige Frage der Pfänd barkeit der Uhr ist die Berufung der Rekurrenten darauf, daß sie sich an ihr das Eigentum vorbehalten hätten. Ihre bezüglichen Ansprüche haben sie durch eine Vindikationsklage vor dem Civil richter geltend zu machen.
