The St. Gallen cantonal court had confirmed Eberle’s placement under guardianship for squandering on application of the local guardianship statute. Eberle then filed a federal appeal without specifying any breach of federal law. The Federal Court held that the filing could not be treated as a state-law appeal and that no federal appeal was available, since the cantonal decision rested on cantonal law and Art. 5 of the Federal Act on Personal Capacity is only a limit on cantonal legislation and adjudication. A filing styled as an appeal to the Federal Court is not a state-law recourse unless it alleges a breach of federal law. Where the cantonal judgment is founded exclusively on cantonal law, and the cited federal provision operates only as a constraint on cantonal lawmakers and courts rather than as a substantive decision norm, no federal appeal lies. The Federal Court will accordingly refuse to enter into the matter (consid. 1).

  1. Urteil vom 18. September 1896 in Sachen Eberle gegen Armenbehörde Amden. Durch Urteil vom 18. Juli 1896 hat das Kantonsgericht St. Gallen in Bestätigung des erstinstanzlichen Urteils, den Joh. Anton Eberle in Amden, auf Begehren der dortigen Armenbehörde unter staatliche Vormundschaft gestellt. Das Gericht stützte sich dabei auf Art. 48 Ziffer 2 des kantonalen Vormund schaftsgesetzes, wo eine Bevormundung wegen Verschwendung vorgesehen ist. Gegen dieses Urteil erklärte unterm 9. August 1896 der Bevollmächtigte des Joh. Anton Eberle durch schriftliche Ein gabe an die Kantonsgerichtskanzlei St. Galler hne weitere Be gründung die Appellation an das Bundesgericht. Der Anwalt der Armenbehörde Amden seinerseits beantragte Gutheißung des angefochtenen Urteils. Das Bundesgericht zieht in Erwägung: Die sog. Appellationserklärung des Joh. Anton Eberle kann ihrer Benennung und Fassung nach nicht etwa als staatsrecht licher Rekurs gegen das angefochtene kantonsgerichtliche Urteil aufgefaßt werden; es müßte doch, um dies annehmen zu können, zum mindesten angegeben sein, inwiefern jenes Urteil gegen Bundesrecht verstoßen soll. Sondern es bezweckt die Appella tionserklärung eine eigentliche Weiterziehung des Urteiles des Kantonsgerichtes an das Bundesgericht, welch' letzteres zur Über prüfung desselben auf der nämlichen gesetzlichen Grundlage ange rufen wird. Eine solche Weiterziehung ist nun aber nicht zulässig. Nicht in Anwendung eidgenössischen, sondern in Anwendung kantonalen Rechtes hat das Kantonsgericht St. Gallen das angefochtene Urteil ausgefällt. Und wenn auch das Bundesgesetz betreffend die persönliche Handlungsfähigkeit vom 22. Brach monat 1881 in Art. 5 gewisse Bestimmungen über die Bevor mundung von Volljährigen enthält, so sind diese, wie in kon stanter Praxis festgehalten worden, nicht als Entscheidungs normen, sondern lediglich als bundesrechtliche Schranken für den kantonalen Gesetzgeber und Richter aufzufassen. War aber im vorliegenden Falle kantonales Recht maßgebend, so schlägt das Rechtsmittel der Berufung, das Joh. Ant. Eberle ergriffen hat, fehl und kann auf dessen Appellationserklärung nicht eingetreten werden. Aus diesen Gründen hat das Bundesgericht erkannt: Auf die Weiterziehung des Joh. Ant. Eberle wird nicht ein getreten.
