The wife sought to overturn a Zurich divorce judgment, arguing that the husband alone had caused the marital discord and therefore could not sue for divorce under Art. 47 CCE. The Federal Court held that the factual findings supported at least shared responsibility for the breakdown and that its review was limited under Art. 30 of the 1874 federal act. It also held that it lacked competence to alter the provisions on the children's upbringing, which were reserved to cantonal law under Art. 49 CCE. The request to amend the judgment was dismissed.

The Federal Court does not re-assess the factual appreciation of the cantonal courts unless it is aktenwidrig; where the record supports the finding that the marital breakdown was not caused solely or mainly by the plaintiff spouse, the divorce under Art. 47 CCE is not to be disturbed (consid. 1-3). Provisions concerning the children's upbringing after divorce fall within cantonal law under Art. 49 CCE; the Federal Court lacks competence to alter such arrangements independently (consid. 4).

Sachverhalt
A. Durch Entscheid vom 30. September d. J. wurde dem Ehemann Fischer eine Frist von sechs Monaten angesetzt, um eine Erklärung des herzoglich braunschweigischen Staatsministeriums beizubringen, daß ein von den schweizerischen Gerichten ausgefälltes Scheidungsurtheil dortseits anerkannt werde Fn. 1: s. oben Seite 332 ff. BGE 2 I 322 . . 1
B. Darauf hat Fischer sich darüber ausgewiesen, daß er nicht mehr braunschweigischer Staatsangehöriger sei, indem er das Bürgerrecht der Gemeinde Außersihl, Kanton Zürich, und das Landrecht in letzterm Kanton erworben habe. 2
