Teyber challenged Zurich’s demand for state tax for 1875, arguing that part of the same assets had already been taxed in Aargau. The Federal Court held that prohibited double taxation requires the same person to be taxed by two cantons on the same tax object. Here, Zurich taxed Teyber personally, while Aargau taxed the firm Teyber und Münz, and the alleged transfer of capital was not proven. The Court further noted that Teyber had not timely pursued the available Zurich procedure to reduce his assessment. The complaint was dismissed.
Double taxation; identity of taxpayer and tax object required. A cantonal tax overlap is only prohibited where the same person is subjected by two cantons to the same tax on the same object. Where one canton taxes the individual personally and the other taxes a partnership or other separate taxable subject, the prerequisite of sameness is lacking unless it is proven that the same assets are in fact duplicated. A party who omits to use the legally available remedy for timely correction or reduction of the assessment cannot invoke resulting disadvantages as constitutionally protected double taxation (consid. 1-2).
einerseits wird im Kanton Zürich Rekurrent persönlich besteuert, während im Kanton Aargau als Steuerobjekt die Firma Teyber und Münz" erscheint und anderseits mangelt jeglicher Beweis dafür, daß Rekurrent dasjenige Vermögen, welches er im Kanton Zürich versteuern muß, in die Gesellschaft Teyber und Münz" eingeworfen habe, beziehungsweise daß seine diesfällige Einlage nicht von anderweitigem Vermögen herrühre. 2. Dazu kommt, daß Rekurrent es versäumt hat, rechtzeitig den ihm gesetzlich im Kanton Zürich behufs Reduktion seines dort steuerpflichtigen Vermögens offen stehenden Weg zu be treten und daher die Doppelbesteuerung, wenn eine solche wirk lich vorliegen sollte, lediglich eine Folge dieser Nachlässigkeit ist. Gegen solche, durch Nichtergreifung der gesetzlichen Rechtsmittel selbst verschuldete Nachtheile kann das Bundesgericht nicht schützen. Demnach hat das Bundesgericht erkannt: Die Beschwerde ist als unbegründet abgewiesen.
