Alexander Hodel sought annulment of the Thun correctional judgment and the Bern police chamber's interlocutory decision, arguing that a jury court had jurisdiction over the alleged press offense. The Federal Court did not reach the jurisdiction question. It held that the federal complaint was filed after the sixty-day deadline of Art. 59 O.G.; because the final day fell on a Sunday, the complaint still had to be posted by that day and could not validly be filed on the next day. The complaint was therefore declared late and rejected without examination on the merits.
Art. 59 O.G.; computation of the sixty-day federal complaint period in state-law matters; if the last day falls on a Sunday, the complaint must nevertheless be filed by that day, as the civil-procedure rule extending the deadline to the next working day is inapplicable to staatsrechtliche Sachen.
