Albert Tiarks appealed to the Federal Court after the Zurich Appellationskammer rejected his divorce action against Barbara Elisa Binder for lack of the proof required by Art. 56 C.St.G. He relied on a Hamburg justice authority certificate stating that a Swiss divorce judgment based on his Swiss domicile would be recognized there. The Federal Court held that strict proof of recognition in the home state is required and that the submitted certificate did not establish this with sufficient certainty. The recourse was therefore dismissed.
Art. 56 C. St. G.; proof of recognition of a Swiss divorce judgment in the parties' home state. The requirement is satisfied only by strict proof that the foreign state will recognize the Swiss judgment. A mere administrative certificate is insufficient if its competence, binding effect, or substantive reliability is doubtful. The cantonal court may deny the request where reciprocity or enforceability abroad is not established with certainty (consid. 2).
