The Federal Court held that a state-law appeal under Art. 59 O.G. is only timely if the substantiated appeal brief, containing the factual and legal grounds and the requests, is filed within the statutory period. A mere prior notice of appeal does not preserve time. Because the cantonal judgment was served on 1890-02-01 and the brief was posted only on 1890-04-05, the appeal was late and could not be heard.
Art. 59, 61 O.G.; state-law appeal time limit and effect of a mere notice of appeal: the statutory appeal period is preserved only by filing, within time, the appeal brief itself containing the factual and legal grounds and the prayers for relief. A preliminary declaration that an appeal will be brought is insufficient and does not suspend or extend the deadline. Otherwise, the clear wording and purpose of the law would be circumvented by an impermissible extension of the appeal period (consid. 1-2).
thurgauischen Obergerichtes vom 1. Februar l. J. als verfassungs verletzend zu erklären und aufzuheben. Das Waisenamt Horn beantragt in seiner Vernehmlassung auf diese Beschwerde, es sei auf den Rekurs nicht einzutreten, even tuell derfelbe als unbegründet abzuweisen. Das Obergericht des Kantons Thurgau schließt sich den Aus führungen des Waisenamtes Horn an. Der Antrag, es sei auf die Beschwerde nicht einzutreten, wird damit begründet, dieselbe sei, weil nicht binnen der sechzigtägigen Rekursfrist des Art. 59 O. G. eingereicht, verspätet. Das Obergericht bemerkt dabei speziell, daß die Eröffnung des angefochtenen Urtheils an den Rekurrenten am 1. Februar 1890 erfolgt sei. Das Bundesgericht zieht in Erwägung:
