C. Gerichtsentscheide 3119,3120 3119 Treuepflicht nach Abschluss eines Auftragsverhältnisses. Die Aufsichtskommission hält dafür, dass es nicht tunlich ist, wenn der An­walt einen neuen Auftraggeber gegen die frühere Klientin vertritt. Zu­nächst erscheint es heute noch als fraglich, ob es hier überhaupt zu einem Prozess kommen muss; vgl. Art.416ZGB und dazu Egger, N.3 zu Art.416 ZGB. Lässt sich ein Rechtsstreit über diese Forderung aber nicht umgehen, so hat der Beirat seine Bemühungen und Ansprüche im einzelnen zu be­weisen. Dabei handelt es sich teilweise um Besprechungen, die der Beirat mit dem damaligen Berater der heutigen Beklagten führte. Will der Anwalt den neuen Klienten sachgemäss vertreten - er ist dazu nach Art. 398 OR verpflichtet -, so muss er alle die früheren Besprechun­gen wie auch die persönlichen und finanziellen Verhältnisse und Anliegen der Beklagten, seiner damaligen Klientin, dartun. Dies kann er als ihr frü­herer Anwalt nicht tun, ohne Kenntnisse aus jenem Mandat zu verwerten. Er kann den neuen Klienten nicht vertreten, ohne die frühere Auftraggebe­rin zu verraten; verzichtet er auf letzteres, so muss der neue Auftrag darun­ter leiden. Dr. Blass führt in seinem Referat über die Standespflichten der Rechtsanwälte, Zürich, 1945, S. 21, daher zu Recht aus, der Klient müsse sich darauf verlassen können, dass die Kenntnis seiner Persönlichkeit, sei­ner Fehler und Mängel, seiner finanziellen Verhältnisse nicht vom Anwalt gegen ihn in irgendeiner Weise ausgenützt werde. Dem Anwalt ist daher nahezulegen, auf die weitere Vertretung des Klä­gers im Prozess gegen seine frühere Klientin zu verzichten.
