C. Gerichtsentscheide 3003, 3004 1.2 Fam ilienrecht 3003 Ehescheidung. Vorsorgliche Massnahmen für die Dauer des Scheidungs­verfahrens. Unterhaltsanspruch der Ehefrau auch im Falle von Ehebruch bejaht. Mit Sorgfalt ist die Vorinstanz den Ausführungen von Bühler, N.131 ff. zu Art. 145 ZGB, nachgegangen. Aber gerade dieser Kommentator nimmt es mit den Ausnahmen der ehelichen Unterhaltspflicht sehr streng. Der Unterhaltsanspruch während des Scheidungsverfahrens steht auch der Ehefrau zu, die Ehebruch begangen hat. Ein Konkubinat führt nur dann zur Entlastung des unterhaltspflichtigen Ehemannes, wenn die Frau in der neuen Gemeinschaft faktisch die Stellung der Ehefrau einnimmt (Bühler, N.131 und 134 zu Art. 145 ZGB). Mit der Auskunft der Einwohnerkontrolle, X. sei nicht am Wohnort der Ehefrau gemeldet, entfällt fürs erste die Vermutung des dauernden Zu­sammenlebens. Ob polizeiliche Abklärungen doch eine derartige Lebens­gemeinschaft erweisen, kann offen bleiben. JuAK 15.9.1978 (RBer 1978/79, S. 45) 3004 Ehescheidung. Nachträgliche Klage aus Güterrecht (Art.154 ZGB). Beim Güterstand der Gütertrennung gibt es kein eheliches Vermögen. Bei der Scheidung können indessen auch unter diesem Güterstand Differen­zen über die gegenseitigen Forderungs- und Eigentumsverhältnisse beste­hen. Derartige Streitigkeiten sind ebenfalls im Verfahren nach A rt.154 ZGB, d.h. im Rahmen des Scheidungsprozesses abzuhandeln (Bühler/ Spühler, N .7zu A rt.154 ZGB, mit eingehenden Hinweisen). Es steht den Ehegatten frei, ob sie an den andern Teil güterrechtliche Ansprüche stellen wollen (BGE 67 I I8); sie bestimmen durch ihre Anträge den Umfang der richterlichen Prüfung.
