The requirement of professional liability insurance is met where the contractual arrangement provides the requisite coverage. No obstacle arises from professional secrecy where the mandate documentation contains a valid release for disclosure to an audit body. The decisive question is whether the overall structure preserves the lawyer's professional autonomy and compliance with the BGFA requirements.

2009 Anwaltsrecht 51 schon von vornherein absehbar. So erscheint insbesondere die Ausübung des Mandates im eigenen Namen und auf eigene Verantwortung (Art. 12 lit. b BGFA) auch im Rahmen eines Anstellungsverhältnisses unter den in Statuten und Organisationsreglement gesetzten Rahmenbedingungen problemlos möglich, und die Verantwortlichkeit gegenüber der disziplinarischen Aufsichtsbehörde bleibt bestehen. Das Erfordernis des Abschlusses einer Berufshaftpflichtversicherung (Art. 12 lit. f BGFA) erfüllen die Gesuchsteller bei Abschluss des Vertrages gemäss eingereichter Offerte ebenfalls. Ebenso sind bezüglich Berufsgeheimnis (Art. 13 Abs. 1 BGFA) keine Probleme ersichtlich, da vorgesehen ist, mit den Mandanten einen schriftlichen Mandatsvertrag mit Entbindungserklärung hinsichtlich des Berufsgeheimnisses gegenüber einer allfälligen Revisionsstelle abzuschliessen. Somit kann festgestellt werden, dass einer Aufrechterhaltung des Registereintrages der Gesuchsteller nach deren Anstellung in der zu gründenden "X. Rechtsanwälte AG" nichts entgegensteht, soweit die eingereichten Unterlagen hierbei zur Anwendung kommen. 8 Art. 12 lit. a BGFA Verbot des Direktkontakts mit anwaltlich vertretener Gegenpartei; gilt nicht absolut, sondern ist unter Würdigung aller Umstände zu handhaben. Zulässigkeit des Direktkontakts, wenn Gegenpartei Kontakt selber sucht sowie bei anderen triftigen Gründen, z.B. bei zeitlicher Dringlichkeit. Entscheid der Anwaltskommission vom 17. (AVV.2009.18). 9 Art. 13 BGFA Tötung der Ehefrau (Klientin im Eheschutzverfahren), Entbindung der Anwältin vom Berufsgeheimnis im polizeilichen Ermittlungsverfahren gegen den Ehemann (Täter). An der Abklärung der Motive des Täters besteht ein höherwertiges Interesse als an der Aufrechterhaltung des Berufsgeheimnisses.
