Resumo Omnilex

The appellants challenged a Regierungsrat decision concerning a mobile phone antenna in an agricultural zone. The Verwaltungsgericht rejected the request to restore the time limit and held that the complaint filed on 31 January 2005 could not be entered because the deadline had been missed. In the merits discussion, the court confirmed the antenna’s relative site dependence under Art. 24 RPG, after assessing alternative locations and spatial-planning interests. It also stated that appellate authorities apply the law ex officio and are not bound by the parties’ legal reasoning.

Sumário Omnilex

Art. 24 RPG; relative site dependence of a mobile phone antenna outside the building zone; restoration of time limits and admissibility. A mobile phone antenna may be regarded as relatively site-bound outside the building zone if no suitable and reasonable location exists within the building zones. In the spatial-planning balancing of interests, alternative sites outside the building zones must be examined and the degree of exploitation of emission limit values may be taken into account. On appeal, the authority applies the law ex officio within the object of the dispute and is not bound by the parties’ legal assessment (consid. 2/a).
