  • Wird eine Verfügung mit gewöhnlicher Post zugestellt, fällt die Beweislast für das Empfangsdatum der Behörde zu, weil sie durch den uneingeschriebenen Versand der Verfügung die Beweislosigkeit verursacht hat; wird die Tatsache oder das Datum der Zustellung uneingeschriebener Sendungen bestritten, muss daher im Zweifel auf die Darstellung des Empfängers abgestellt werden.
