Gegen Entscheide und Verfügungen letzter Instanzen in Handelsregistersachen kann nämlich Verwaltungsgerichtsbeschwerde erhoben werden (Art. 5 Abs. 1 HRegV). Die sachliche Zuständigkeit des Verwaltungsgerichts ist mithin zu bejahen. b) Zu prüfen ist noch die funktionelle Zuständigkeit des Verwaltungsgerichts. Wenn nämlich ein Departement wie im vorliegenden Falle erstinstanzlich entscheidet, so gilt auch in Fällen, in denen letztinstanzlich ein Weiterzug an das Verwaltungsgericht möglich ist, normalerweise die Regelung, dass zunächst die Beschwerde
