Resumo Omnilex

F.S. challenged the district doctor’s order retaining him in Klinik Königsfelden for examination. The Administrative Court held that examination commitment is only lawful where a concrete inquiry mandate is set out and the missing factual basis for a definitive protective-detention decision is specified. It further held that coercive measures are generally not allowed at the examination stage, because definitive protective detention is not yet established; only emergency measures remain possible. The court also stated that the External Psychiatric Service is not an institution under Art. 397a para. 1 ZGB and that outpatient psychiatric follow-up treatment after release from protective detention is not a coercive measure. The declaratory request concerning treatment of 2 September 2002 was dismissed.

Sumário Omnilex

§ 67d EG ZGB; § 67e bis Abs. 3 EG ZGB; Art. 397a Abs. 1 ZGB; examination commitment and coercive measures: an examination commitment is admissible only where objective indications render protective detention seriously conceivable and the competent authority still lacks essential factual bases for a definitive commitment decision; it must define the required inquiries concretely and precisely. If the mandate is lacking, the commitment is incomplete and to be set aside, subject to a short curative period (consid. B). Coercive measures presuppose an actual protective-detention framework; they are therefore in principle excluded at the examination stage, where only emergency measures may be taken (consid. C). The External Psychiatric Service is not an institution within the meaning of Art. 397a para. 1 ZGB; outpatient psychiatric follow-up treatment ordered on release from protective detention does not constitute a coercive measure under § 67e bis EG ZGB (consid. 2d).

200Verwaltungsgericht2002 Feststellungsbegehren betreffend Behandlung vom 2.

Kammer, vom 6.

Whether an examination commitment without a concrete inquiry mandate is valid.

Decisão extraída

An examination commitment must specify clearly and precisely what is to be examined or clarified; without a concrete inquiry mandate it is incomplete and must be set aside, though the authority may first be given a short period to cure the defect.

Fundamentação extraída

The deciding authority must itself define what factual basis is still missing. Examination commitment is only lawful if objective indications justify possible protective detention, the missing basis is substantial, the clinic has the necessary expertise, and outpatient clarification is impossible.

Questão jurídica principal

Whether coercive measures are permissible during an examination commitment.

Decisão extraída

Coercive measures are generally not permissible during an examination commitment, because it is not yet established that the conditions for definitive protective detention and forced treatment exist; only emergency measures remain available.

Fundamentação extraída

Coercive measures may be ordered only within the framework of protective detention. At the examination stage, the conditions for such detention are still unresolved.

Questão jurídica principal

Whether the declaratory request concerning treatment of 2 September 2002 should be granted.

Decisão extraída

The declaratory request concerning the treatment of 2 September 2002 is dismissed.

Fundamentação extraída

The court found no basis for granting the requested declaration on the treatment measure.

Questão jurídica principal

Whether the External Psychiatric Service is an institution within the meaning of Art. 397a para. 1 ZGB and whether outpatient psychiatric follow-up treatment ordered upon release is a coercive measure.

Decisão extraída

The External Psychiatric Service is not an institution within the meaning of Art. 397a para. 1 ZGB, and outpatient psychiatric follow-up treatment based on a release directive from protective detention is not a coercive measure under § 67e bis EG ZGB.

Fundamentação extraída

The court distinguished between institutional detention and outpatient follow-up treatment after release, holding that the latter does not amount to a coercive measure in this statutory sense.
