The Administrative Court, 2nd Chamber, upheld the tax appeal decision. § 26 Abs. 1 StG; Abzugsfähigkeit von BVG-Einlagen und Steuerumgehung. Kapitaleinlagen zum Einkauf von Lohnaufbesserungen oder zusätzlichen Beitragsjahren sind grundsätzlich unbeschränkt abzugsfähig, sofern sie reglementarisch vorgesehen und angemessen sind; dies gilt auch bei Einzahlung kurz vor dem reglementarischen Schlussalter und anschliessendem Kapitalbezug. Eine Steuerumgehung fällt nur dahin, wenn die Einlage nicht mit einem genügenden wirtschaftlichen Vorteil verknüpft ist (consid. betreffend BVG-Einlagen). Eine Überführung von Geschäfts- ins Privatvermögen kann aus einer entgeltlichen Vermietung an eine vom Steuerpflichtigen mitgetragene Kollektivgesellschaft nur dann zwingend geschlossen werden, wenn sowohl eine spätere geschäftliche Nutzung als auch eine blosse Übergangsregelung ausgeschlossen erscheint.

Steuerumgehung. -Kapitaleinlagen zum Einkauf von Lohnaufbesserungen oder zusätzlicher Beitragsjahre sind grundsätzlich ohne Beschränkung abziehbar, soweit sie reglementarisch vorgesehen und angemessen sind. Dies gilt selbst dann, wenn die Einlage nur rund 1 Jahr vor dem reglementarischen Schlussalter erfolgte und die BVG-Leistung in Kapitalform bezogen wurde. -Keine Steuerumgehung, falls die Kapitaleinlage mit einem ausreichenden wirtschaftlichen Vorteil verknüpft ist. Zur Publikation vorgesehen in StE 2003. 52 Überführung von Geschäfts- ins Privatvermögen (Privatentnahme). -Aus der vom Steuerpflichtigen nicht als Überführung deklarierten entgeltlichen Vermietung von grossen Teilen des Geschäftsvermögens an eine Kollektivgesellschaft, an welcher der Steuerpflichtige beteiligt ist, muss die Steuerbehörde nur dann zwingend auf eine Überführung ins Privatvermögen schliessen, wenn eine Rückkehr zur geschäftlichen Nutzung ebenso ausgeschlossen erscheint wie die Annahme einer vorläufigen Regelung zur Überbrückung eines Schwebezustands (vgl. auch AGVE 2000, S. 139 f.; 1995, S. 201 ff.; 1991, S. 247).
