M.J.M. challenged the cost order in tax appeal proceedings after the tax assessment against him had been annulled for lack of local jurisdiction. The Verwaltungsgericht held that its jurisdiction over the main matter also covered ancillary cost issues and that the cost order could be contested independently. It further held that standing existed only insofar as the appellant sought exemption from procedural costs, not as to the allocation of costs to other persons. The court accepted that costs may be imposed on a successful appellant when he raises factual elements too late. The complaint was dismissed.

§ 52 Ziff. 19 VRPG; Zuständigkeit des Verwaltungsgerichts für die Anfechtung von Kostenentscheiden im Zusammenhang mit Beschwerden betreffend Strafaufschub bzw. Nebenpunkten: Besteht die Zuständigkeit in der Hauptsache, erstreckt sie sich ohne Weiteres auch auf Nebenfolgen wie die Kostenverlegung; der Kostenpunkt ist zudem selbständig anfechtbar. Ein schutzwürdiges Interesse liegt hinsichtlich der eigenen Kostenbefreiung vor, nicht aber bloss zur Klärung, wer die Kosten sonst zu tragen hat. Die Kostenauflage an eine obsiegende Partei kann sich auf verspätete tatsächliche Vorbringen stützen; verspätete rechtliche Argumente rechtfertigen eine solche Kostenfolge grundsätzlich nicht (Erw. 352 Verwaltungsgericht 2000 84 Zuständigkeit des Verwaltungsgerichts zur Beurteilung von Beschwerden betreffend Strafaufschub (§ 52 Ziff. 19 VRPG).

  • Vorfrageweise Prüfung (und Bejahung), ob das Bundesgericht die Zulässigkeit der Verwaltungsgerichtsbeschwerde (Art. 97 ff. OG) hinsichtlich des Strafaufschubs bejahen würde (Erw. 1). Vgl. AGVE 2000, S. 127, Nr. 35 85 Zuständigkeit. Beschwerdelegitimation. Kostenauflage.
  • Ist die Zuständigkeit des Verwaltungsgerichts im Hauptpunkt gegeben, so erstreckt sie sich auch auf Nebenpunkte wie die Kostenverlegung; der Kostenpunkt kann auch allein angefochten werden (Erw. I/1).
  • Schutzwürdiges Interesse als Voraussetzung der Beschwerdelegitimation: Gegeben, soweit die Befreiung von Verfahrenskosten verlangt wird, nicht aber hinsichtlich der Frage, wer sonst die Kosten zu tragen hat (Erw. I/2).
