Bei einer solchen handelt es sich rechtlich um ein Darlehen der Aktiengesellschaft an den Aktionär, welches bei Vorliegen des (späteren) Generalversammlungsbeschlusses mit dem dann entstandenen Anspruch des Aktionärs auf die Dividende verrechnet wird (Peter Böckli, a.a.O., § 12 N 533).

Die als Darlehen zu qualifizierende à conto-Dividende kann demnach kein steuerbares Einkommen darstellen. Eine vor dem Generalversammlungsbeschluss erfolgte Auszahlung der Dividende hat somit keinen Einfluss auf die nach Steuerrecht vorzunehmende zeitliche Zurechnung. Auch dann gilt die Dividende erst im Zeitpunkt des Beschlusses als realisiert.

Die im Zusammenhang mit der selbständigen Nebenerwerbstätigkeit anfallenden Gewinnungskosten sind unter diesem Titel abschliessend geltend zu machen. Wird die erforderliche Abklärung unterlassen, liegt keine neue Tatsache vor.
