The Constitutional Court upheld a constitutional complaint against a challenged judgment. It held that the complainant had been violated in the constitutionally guaranteed right to equal treatment of foreigners among themselves under Art I(1) of the Federal Constitutional Act BGBl No 390/1973. The challenged judgment was annulled, and the Federation, represented by the Federal Minister for the Interior, was ordered to reimburse EUR 3,144 in costs within 14 days.
Art I Abs 1 B-VG BGBl Nr 390/1973; equal treatment of foreigners among themselves: where the challenged decision cannot be reconciled with the constitutional equality guarantee, the Constitutional Court sets it aside. A successful constitutional complaint based on this right leads to annulment of the attacked judgment and, where applicable, reimbursement of process costs to the complainant (cf. dispositive I-II).
I.Die Beschwerdeführerin ist durch das angefochtene Erkenntnis im verfassungsgesetzlich gewährleisteten Recht auf Gleichbehandlung von Fremden untereinander (ArtI Abs1 Bundesverfassungsgesetz BGBl Nr 390/1973) verletzt worden.
Das Erkenntnis wird aufgehoben.
II.Der Bund (Bundesminister für Inneres) ist schuldig, der Beschwerdeführerin zuhanden ihrer Rechtsvertreterin die mit € 3.144,– bestimmten Prozesskosten binnen 14 Tagen bei sonstiger Exekution zu ersetzen.
