Chapter 3354:1-10 Board of Trustees

Ohio Adm.Code 3354:1-10-01 Board of trustees: appointments, resignations, powers and duties and general matters.

(A) Appointment and conditions of office of members of the board:

(1) Nine persons shall be appointed to the board. Six trustees shall be appointed by the Cuyahoga county executive and three trustees shall be appointed by the governor of the state of Ohio.

(2) Each appointment shall be for a term of five years except for those appointments made to fill an unexpired term.

(3) The trustees shall serve without compensation but may be paid for their necessary expenses when engaged in the business of the board.

(4) Before entering upon his or her official duties, each trustee shall take an oath that the trustee will honestly, faithfully, and impartially perform the duties of the office.

(B) Trustees may resign at any time during the term for which they were appointed by instrument in writing to that effect filed with the secretary of the district. Whenever for reason of death or resignation of a trustee there shall be a vacancy in the board, the secretary of the district shall notify the Cuyahoga county executive or the office of the governor of the state of Ohio depending upon the office which is to fill the vacancy.

(C) Powers and duties of the board:

(1) The board shall own and operate the college pursuant to an official plan prepared and approved in accordance with section 3354.07 of the Revised Code.

(2) The board may hold, encumber, control, acquire by donation, purchase or condemnation, construct, own, lease, use, and sell real and personal property as is necessary for the conduct of the program of the college on whatever terms and for whatever consideration may be appropriate for the purpose of the college.

(3) The board may accept gifts, grants, bequests, and devices absolutely or in trust for support of the college.

(4) The board may appoint the administrative officers, faculty and staff necessary and proper for the college, and fix their compensation.

(5) The board shall provide for the college necessary lands, buildings or other structures, equipment, means, and appliances.

(6) The board shall develop and adopt, pursuant to the official plan, the curricular programs identified in section 3354.01 of the Revised Code as arts and sciences programs and technical programs, or either. Such programs may include adult education programs.

(7) The board shall establish schedules of fees and tuition.

(a) The board shall establish such schedules for students who are residents of the district; residents of Ohio but not of the district; and students who are nonresidents of Ohio.

(b) Students who are nonresidents of Ohio shall be required to pay higher rates of fees and tuition than the rates required of students who are residents of Ohio but not of the district, and students who are residents of the district shall pay a smaller tuition and fee rate than the rate for either category of nonresident students.

(8) The board may authorize, approve, ratify, or confirm any agreement relating to the college with the United States government, acting through any agency of such government designated or created to aid in the financing of such projects, or with any person, organization, or agency offering grants in aid in financing such educational facilities or the operation of such facilities except as prohibited by law.

(9) The board may grant appropriate certificates of achievement to students successfully completing college programs.

(10) The board may prescribe policies regarding the effective management of the college, and exercise such other powers as are necessary for the efficient management of the college. The board shall appoint the president, who shall be responsible for establishing the procedures to carry out such rules or policies.

(11) The board may receive and expend gifts or grants from the state of Ohio for the payment of operating costs, for the acquisition, construction, or improvement of buildings or other structures, or for the acquisition or use of land. In no event shall state gifts or grants be expended for the support of adult education programs.

(12) The board may retain consultants in the field of education, planning, architecture, law, engineering, or other fields of professional skill.

(13) The board may purchase such policies of insurance as permitted by the Revised Code or as otherwise not prohibited by law.

(14) The board may exercise all other powers and duties authorized from time to time by the laws of the state of Ohio.

(D) General matters.

(1) The board shall adopt a seal, and shall keep records of all its proceedings, which records shall be open for public inspection to the extent required by law.

(2) A majority of the board shall constitute a quorum, and the board may act on any matter by majority vote of its whole membership. The board may designate in its rules and regulations matters of an administrative nature which may be acted upon by a vote of a majority of those present when a quorum is in session.

(3) Any rule or regulation adopted by the board to govern its own proceedings may, when not otherwise required by law, be temporarily suspended; provided that a majority of those present when a quorum is in session determine by affirmative vote that such action will serve the best interests of the college.

(4) The principal place of business of the college is "700 Carnegie Avenue, Cleveland, Cuyahoga County, Ohio."

(5) The board shall perform a biennial evaluation of the college president and the progress of the institution under the president's leadership in light of the strategic plan, annual goals, and other standards set by the board. The chairperson of the board shall be responsible for initiating the biennial evaluation and for holding more frequent performance review discussions with the president. The board may appoint a special committee to assist the body in carrying out the evaluation responsibility.

(6) Communications by college employees to the board.

(a) Communications to the trustees from college employees will be transmitted to the full board or, as appropriate, to a committee of the board by the college president or an executive vice president.

(b) All board responses to such communications will be made either through the president, an executive vice president or, as appropriate, by action in full board meetings.

(7) The bylaws of the board consist of rules 3354:1-10-01 to 3354:1-10-05 of the Administrative Code.

(8) The board shall review and evaluate college policies at regular intervals. The board will take action on the adoption, modification, or rescission of all policies.

Ohio Adm.Code 3354:1-10-05

(A) In accordance with division (F) of section 121.22 of the Revised Code, the board must:

(1) Establish a reasonable method whereby any person may determine the time and place of all regularly scheduled meetings and the time, place, and purpose of all special meetings.

(2) Make provisions for giving at least twenty-four hours advance notice of special meetings to the news media that have requested notification (except that in the event of emergency requiring immediate official action, immediate notice shall be given), and

(3) Make provisions for persons, upon request and for payment of a reasonable fee, to obtain reasonable advance notification of all meetings at which any specific type of public business is to be discussed.

(B) The office of the secretary.

Any person may visit or telephone the office of the secretary during the office's regular office hours to determine, based on information available at that office, the time and place of regular meetings; the time, place, and purposes of any then known special meetings; and whether the available agenda of any such future meeting states that any specific type of public business, identified by such person, is to be discussed at such meeting.

(C) Notification of news media.

Any news media that desire to be given advance notification of special meetings of the board must file with the secretary a written request therefor. Except in the event of an emergency requiring immediate official action, a special meeting shall not be held unless at least twenty-four hours advance notice of the time, place and purpose of such special meeting is given to the news media that have requested such advance notification in accordance with this rule.

(1) News media requests for such advance notification of special meetings shall specify the name of the requesting organization and the name and address of the person to whom written notifications to the medium may be mailed or delivered, and the name, addresses, and telephone numbers (including addresses and telephone numbers at which notification may be given either during or outside of business hours) of at least two persons to either one of whom oral notifications to the medium may be given and at least one telephone number that the request identifies as being one which can be called at any hour for the purpose of giving notification.

(2) Any such request shall be effective for one year from the date of filing with the secretary or until the secretary receives written notice from the requestor canceling or modifying such request, whichever is earlier. Each requestor shall be informed of such period of effectiveness at the time it files its request. Such requests may be modified or extended only by filing a complete new request with the secretary. A request shall not be deemed to be made unless it is complete in all respects. All requests may be conclusively relied on by the board and the secretary.

(3) The secretary shall give such oral notification or written notification, or both, as the secretary determines, to the news media that have requested such advance notification in accordance with this rule of the time, place, and purposes of each special meeting as will provide for receipt of such notification at least twenty-four hours prior to the time of such special meeting.

(4) In the event of an emergency requiring immediate official action, a special meeting may be held without giving twenty-four hours advance notification thereof to the requesting news media. One or more trustees calling such a meeting, or the secretary on their behalf, shall immediately give oral notification or written notification, or both, of the time, place, and purposes of such special meeting to such news media that have requested such advance notification in accordance with this rule. The minutes or the call, or both, of any such special meeting shall state the general nature of the emergency requiring immediate official action.

(D) Notification of persons.

Any person, upon written request and as provided herein, may obtain reasonable advance notification of all meetings at which any specific type of public business is scheduled to be discussed.

(1) Such person may file a written request with the secretary specifying the person's name, and the address(es) and telephone number(s) at or through which the person can be reached during the outside of business hours, and the specific type of public business discussions for which the person is requesting advance notification. Such request will be valid for six months, after which a new request may be filed. Such request may be canceled by notice from the person to the secretary.

(2) Each such request must be accompanied by cash, or a check or money order payable to the college, in the amount of one dollar for each month covered by the request, which amount has been determined by the board to represent a reasonable fee to cover costs of providing such advance notification.

(E) The secretary shall maintain a record of the date and manner, and time if pertinent under these rules, of all notices and notifications given or attempted to be given.

(F) Any notification provided herein to be given by the secretary may be given by the secretary's designee.

(G) Definitions. As used in these rules:

(1) "Day" means calendar day.

(2) "Meeting" means any prearranged discussion of the public business of the board by a majority of trustees.

Ohio Adm.Code 3354:1-10-02 Election and duties of Board and College officers.

(A) Elections of board and college officers.

(1) Appointment of a nominating committee.

The chairperson of the board shall, at the regular meeting in April, or if the board meets in May, at its regular meeting in May, appoint a nominating committee consisting of three trustees. This committee shall prepare a proposed slate of officers of the board and the college and present it to the board at the regular meeting in June.

(2) Nominating committee deliberations.

The nominating committee will conduct its deliberations considering all board and college officer positions to be open. Any trustee can be selected for any board officer position. The nominating committee will, in developing a proposed slate of board officers, determine each individual's willingness to spend the time required by the offices.

(3) Officers of the board.

The board at its organization meeting shall elect a chairperson and a vice chairperson, both of whom shall be trustees. There shall be no automatic succession from vice chairperson to chairperson. The offices of chairperson and vice chairperson of the board shall be rotated among those trustees who evidence a willingness to spend the time required by these offices. In the case of temporary absence or incapacity of the chairperson and the vice chairperson, the board may elect a chairperson pro tempore from among its membership.

(4) Officers of the college.

The board shall also elect a secretary and a treasurer of the college. The president will normally be elected to fill the office of secretary. The board may elect such additional officers of the board and the college as it deems necessary. No college officer or other employee may be a trustee while employed by the college.

(5) Terms of office.

A term of office for the officers of the board and the college shall be for one year except in cases of death, resignation, incapacity, or removal. The officers shall serve until the close of the organization meeting of the board next following their election and until their respective successors are elected and qualify. The chairperson pro tempore, if any, shall serve at the pleasure of the board but in no event longer than the period of absence or incapacity of the chairperson and vice chairperson.

(6) Vacancies.

In the event a term of office is not completed, a vacancy in any board or college office (except that of trustee) may be filled for the unexpired term by election of the board without use of a nominating committee.

(B) Duties of board and college officers.

(1) The chairperson of the board shall preside at meetings of the board and may execute deeds, mortgages, bonds, contracts and other obligations authorized by the board in the name of the college and shall perform such other duties as the board may require.

(2) The vice chairperson of the board shall, during the absence or incapacity of the chairperson of the board exercise the powers of the chairperson of the board and shall perform such other duties as the board may require.

(3) A chairperson pro tempore of the board shall, during the absence or incapacity of the chairperson of the board and the vice chairperson of the board, exercise the powers of the chairperson of the board and shall perform such other duties as the board may require.

(4) The secretary shall keep records of all of the proceedings of the meetings of the board. The secretary shall be responsible for giving notice of meetings, and shall perform such other duties as the board may require.

(5) The treasurer shall be the college's fiscal officer, shall receive and, at the direction of the board, disburse all funds of the college, and shall perform such other duties as the board may require.

(6) Other officers shall perform such duties as the board may require.

(7) Notwithstanding any other provisions of these bylaws, but subject to the provisions of Chapter 3354. of the Revised Code, the board at any time may limit the powers of all officers, delegate to any officer the power and duties of any other officer, rescind any action taken by any officer (subject to the rights, if any, of third persons) and control and remove any officer at any time.

Ohio Adm.Code 3354:1-10-03 Board of tustees: committees.

(A) The standing committees of the board shall be:

(1) Executive committee

(2) Access, Learning and Success

(3) Management committee

(4) Community affairs committee

(5) Investment committee

(6) Audit committee

(B) Special committees.

The board may by resolution establish special committees and subcommittees which shall be temporary and expire when determined by the establishing (or any subsequent) resolution, or if not determined by any such resolution, at the end of the fiscal year in which they were created unless renewed by a majority vote of a quorum present and voting at a regular meeting.

(C) Membership, voting, and terms of board committees.

(1) Membership.

(a) The access, learning and success, community affairs, management, investment and audit committees shall have at least three trustees with the committee chairperson being a trustee appointed by the board chairperson. The executive committee shall consist of the board chairperson, the board vice-chairperson, and the chairs of the access, learning and success, community affairs, and management committees. The chairperson of the board of trustees shall be the chairperson of the executive committee.

(b) Each special committee shall have from one to nine trustees, with the committee chairperson being a trustee appointed by the board chairperson.

(c) Each standing committee or special committee may have advisory (nonvoting) members who may be appointed by the board chairperson at the request of the committee chairperson. It is intended that this will enable non-trustees with some expertise, civic interest, or identification to contribute to the work of the college on a limited yet formal basis.

(2) Voting.

Only committee members who are trustees shall be entitled to vote on matters before the committee. Actions may be taken by an affirmative vote of a majority of committee members present. A member of the executive committee serving in more than one of the committee membership positions, shall represent each position without need for additional executive committee members, but shall have only one vote.

(3) Terms of office.

The terms of office for each committee chairperson, each trustee on a committee, and each advisory member on a committee shall be the shortest of (a) one year from appointment, (b) the duration of the committee, or (c) such term as may be identified by the chairperson of the board at the time the chairperson makes the appointment or thereafter. This paragraph shall not apply to members of the executive committee.

(D) Functions of the standing and special committees are as follows:

(1) The board may assign to all committees such duties as it sees fit. The board may issue guidelines for committee operations, in addition to any rules the board may set forth.

(2) Generally, committees shall function with the aid of college employees so as to evaluate assigned policies, issues, plans, proposals, and goals by ascertaining facts, studying questions, seeking alternatives, gaining the benefit of the experience and insights of interested or affected people in the community, and advising the board of its findings.

(a) Committees shall be responsible for formulating policies, plans, and goals in their assigned areas of responsibility and, to that end, shall review employee reports and communications duly submitted to the board, so as to benefit from such information in drawing up final recommendations for action to be considered by the board.

(b) Within the limit of their charge, committees shall function as extensions of the board with the right to call meetings, discuss policies and proposals, draft and submit reports for the consideration of the board, and engage in such other activities necessary and proper to fulfilling their charges.

(c) Such subcommittees as may be created shall function with the aid of college employees as the agents of their respective parent committees. Within the limit of their charge from the parent committee, subcommittees shall have the right to call meetings, discuss relevant matters, and draft and submit reports for the consideration of the parent committee. Each subcommittee shall include at least one trustee and may include advisory members. The committee chairperson shall make all appointments to subcommittees, shall determine the duration of subcommittees (which shall not be longer than the duration of the committee), and shall determine the terms of service of all subcommittee members.

(E) Charges of standing committees.

(1) The access, learning and success committee is hereby charged to advise the board concerning:

(a) Educational needs.

(i) Studying the nature and extent of educational needs and wants of the target population,

(ii) Reviewing periodically the educational programs of the college and identifying the gaps between what is needed and what is currently being provided,

(iii) Identifying educational program goals and formulating courses of action to coordinate the fulfillment of these unmet needs,

(iv) Establishing the order in which educational program needs are to be met.

(b) Official plan of the college.

(i) Overseeing the process of updating the college's official plan, and

(ii) Overseeing the annual detailed planning process that flows from the official plan (including the annual budget preparation process insofar as program content is concerned).

(c) Assessment of educational program effectiveness.

(i) Assessing, on the basis of periodical college employee reports and direct observation, the effectiveness of the educational programs of the college, and

(ii) Overseeing the establishment and operation of a program evaluation process and ensuring that such process is integrated with the planning processes of the college.

(2) The management committee is hereby charged to advise the board concerning:

(a) Financial operations.

(i) Monitoring and reporting to the board on the monthly financial reports of the college and taking appropriate action, if warranted, to preserve the financial position of the college, and

(ii) Reviewing the budget planning process of the district and the college, ensuring that it is sound technically and in terms of program needs.

(b) Personnel operations.

(i) Periodically examining and improving the college's human resources systems, including without limitation recruitment practices, salary comparability, and compensation plans,

(ii) Considering, as appropriate, revisions of and modifications to current human resources policies, procedures, and practices,

(iii) Promoting professional development and personal growth among all employees of the college and providing the leadership to monitor employee progress, and

(iv) Serving, as required, to support the recruitment effort for specified staff personnel.

(c) Contract administration.

(i) Reviewing periodically the contracting practices of the college to ensure that the system effectively and efficiently supports the college's mission, vision, values, plans, and goals,

(ii) Ensuring that the college provides adequate monitoring of contract performance of the college itself, and of the parties with whom the college has contracted.

(d) Facilities management.

(i) Reviewing all plans for new buildings or major renovations of existing buildings to ensure that the needs of the college are being met adequately and economically, and

(ii) Reviewing all proposals to buy land or buildings, and proposals for major leases.

(e) General administration.

(i) Periodically reviewing the organization chart of the college to ensure that it corresponds to actual practice and that its structure promotes effective and efficient management of the college, and

(ii) Ensuring that the policies and procedures of the college promote accountability, effectiveness, efficiency, and economy in operations.

(3) The community affairs committee is hereby charged to advise the board concerning:

(a) Communication with constituencies of the college.

(i) Inviting, soliciting, receiving and considering suggestions, criticisms and other communications from students and Cuyahoga county residents, and

(ii) Determining the most practical and meaningful ways to strengthen communications to and from students and community residents.

(b) Relations with educational and other groups and organizations.

(i) Promoting direct communication with organizations sharing or impacting any part of the college mission and recommending joint meetings and common programs where practical and useful, and

(ii) Exploring ways of generating financial and other support for the college from the Cuyahoga county community.

(c) Proposals for grants.

(i) Receiving and studying proposals for grants in aid from the federal or state government, national or local foundations, and other funds sources, to ensure that no duplication of service or effort is contained therein,

(ii) Ensuring that such proposals incorporate the best available ideas at a reasonable cost, and

(iii) Ensuring that proposals are consistent with the articulated mission, vision, values, and goals of the college.

(4) The executive committee is hereby charged as follows:

(a) To address such matters as may be referred to it by the board of trustees or the board chairperson.

(b) To exercise the authority of the board of trustees consistent with the policies of the board or with any action taken earlier by the board, but only in those emergency circumstances that do not permit the handling of a matter in the normally prescribed manner by the board; and further provided that any action taken by the committee under this paragraph shall be subject to ratification by the board of trustees at its next meeting.

(c) To make recommendations to the board regarding the selection, evaluation and contract of the president of the college.

(5) The investment committee is hereby charged as follows:

(a) Call a meeting of the committee at least quarterly.

(b) Review and recommend revisions to the investment policy.

(c) Advise the board on its investments to assist it in meeting its fiduciary obligations.

(d) Consider the use of advisory committee members as may be authorized under this rule and the investment policy.

(e) Retain an investment advisor meeting the requirements of applicable law and the investment policy and review the performance of the investment advisor.

(f) Make such other recommendations to the board regarding investments and the investment committee as it may deem advisable.

(g) Take such actions or make such recommendations to the board as may be required or authorized and deemed advisable under the investment policy.

(6) The audit committee is hereby charged as follows:

(a) Call a meeting of the committee at least bi-annually with an additional entrance and exit conference with the external audit firm.

(b) Oversee all external audits.

(c) Determine that the accounting system is efficient and effective, within the legal requirements structure.

(d) Ensure that the proper financial systems are maintained, reports issued, audits periodically performed and audit findings compiled expeditiously.

(e) Review annual financial statements (and such other financial statements or reports deemed advisable), internal controls, compliance as it relates to financial reporting and other accounting issues of the college.

(f) Consider the use of advisory committee members as may be authorized under this rule.

(F) Management of meetings of board committees and subcommittees.

(1) The chairperson of a committee and subcommittee shall notify the secretary or the secretary's designee as early as possible regarding the scheduling of meetings. The secretary or the secretary's designee shall be responsible for making the appropriate arrangements (securing a meeting place, notifying the committee or subcommittee members, having the minutes of the meeting taken) and rendering such technical assistance and consultation as is necessary to facilitate the business of the committee and subcommittee.

(2) Regular meetings shall be established by the decision of the majority of the members, and shall be as frequent as necessary to efficiently transact the business of the committee or subcommittee. Generally, there should be one meeting per month held at least one week prior to the scheduled regular board meeting, unless a different schedule is identified in this rule. This paragraph shall not require regular meetings of the executive committee. The executive committee shall meet upon the call of the chairperson of the executive committee.

(3) Special meetings may be called by the committee or subcommittee chairperson. The notice of meeting shall contain a statement of the agenda items to be considered at such a meeting.

(4) Joint committee and/or subcommittee meetings may be called for the consideration of matters of common interest and with the consent of the majority of each joining body. The voting rights of trustees at joint meetings shall be the same as at an individual meeting.

(5) Minutes of meetings shall be kept as a matter of record. College employees shall be provided by the assigned college representatives to ensure this is done. The following shall be recorded: the attendance, the nature and extent of participation in the policy making processes, and a summary of the actions taken and recommendations transmitted to the board.

(6) Reports of a committee shall be scheduled to be heard as agenda items at each regular board meeting. (Subcommittees shall report to committees.) Committee chairpersons are expected to report to the board at that time regarding the progress of committee work. Moreover, chairpersons are expected to make certain that any resolution recommendations made by the committee to the board are transmitted by the secretary to each trustee at least three calendar days prior to the board meeting at which such will be considered.

(7) Quorum is fifty per cent of the total voting membership of any committee or subcommittee.

The parliamentary authority for the conduct of meetings shall be the most current edition of "Robert's Rules of Order, Revised" except when it is inconsistent with Ohio law or previously adopted board policy.

(8) Public meetings will be held for the conduct of all committee business, with the exception being those matters reserved under division (G) of section 121.22 of the Revised Code for board executive session consideration. Executive sessions may be called for such matters; however, no policies or specific decisions will be acted upon in executive session. All other sessions shall be open to the public.

Ohio Adm.Code 3354:1-10-04 Board of trustee meetings: organization and conduct.

(A) The first meeting of the board after June thirtieth of each year, whether such meeting is a regular meeting or a special meeting, shall be the organization meeting of the board.

(1) Regular meetings of the board of trustees shall generally be held at one-thirty p.m., in the months of January, March, May, June, September, October, and December on the fourth Thursday at the principal place of business of the district.

(a) Subject to its bylaws, the board may declare a different time or location within Cuyahoga county for a regular meeting.

(b) No notice of any regular meeting need be given to the trustees when the regular meeting is held at one-thirty p.m. at the principal place of business of the district.

(c) The time and place of a regular meeting may be changed only after delivering written notice to each trustee of the time and place via email or to the trustee's home or business address as it appears in the records of the college (or to the trustee, personally), not less than twenty-four hours prior to such meeting, provided, however, that such notice shall be deemed to have been waived by the trustees who attend such a meeting.

(2) Special meetings of the board may be held at any time and place within Cuyahoga county. Special meetings may be called for either emergency or non-emergency reasons.

(a) Special meetings may be called by the chairperson of the board or by any two trustees.

(b) A non-emergency special meeting may be held only after delivering notice to the trustees of the time, place and purpose of the special meeting to each trustee personally, via email or by delivering the same in writing to the trustee's home or business address as it appears in the records of the college, not less than twenty-four hours prior to such meeting; provided that such notice shall be deemed to have been waived by the trustees who attend such a meeting.

(c) An emergency special meeting may be held only after giving notice to the trustees of the time, place and purpose of the special meeting to the trustee personally, via email or by delivering notice in writing to the trustee's home or business address as it appears in the records of the college; provided that such notice shall be deemed to have been waived by the trustees who attend such a meeting. Such notice must be given at least twenty-four hours in advance, if at the emergency special meeting it is proposed to:

(i) Amend these bylaws,

(ii) Approve or amend the official plan of the college,

(iii) Take action relating to the issuance of bonds or the levying of taxes in accordance with the provisions of section 3354.11 and section 3354.12 of the Revised Code,

(iv) Approve contracts in amounts exceeding two hundred thousand dollars, or

(v) Elect or remove officers of the board or the college.

(B) A majority of the trustees in office at the time shall constitute a quorum, provided that any regular meeting and any special meeting duly called, whether a quorum is present or not, may, by vote of a majority of trustees present, adjourn from time to time and place to place within Cuyahoga county, without notice other than by announcement at the meeting. At any meeting of the board at which a quorum is present, all questions and business relating to matters of an administrative nature, as defined below, shall be resolved or transacted upon the affirmative vote of not less than a majority of the trustees present. All other questions and business shall be resolved or transacted upon the affirmative vote of not less than a majority of all the trustees in office at the time.

(C) The term "matters of an administrative nature" as used in this rule and elsewhere in college policies and procedures shall include all business of the college of whatever nature that may be considered and acted upon by the board except the following:

(1) Amendments to the bylaws,

(2) Approve or amend the official plan of the college,

(3) Action taken relating to the issuance of bonds or the levying of taxes in accordance with the provisions of section 3354.11 and section 3354.12 of the Revised Code,

(4) Approval of contracts in amounts exceeding two hundred thousand dollars,

(5) The election and removal of officers of the board or of the college, and

(6) The selection and removal of the president of the college.

(D) The board encourages the public to attend its meetings. An opportunity will be provided at each meeting for members of the public to address the board.

(1) The board reserves the right to limit such presentations when necessary to permit the transaction of the business of the board.

(2) Individuals or groups (other than employees) wishing to have an item placed on the agenda for the next board meeting must submit a written request to the secretary of the college for consideration no less than two weeks prior to the meeting in question.

(E) The chairperson shall prepare a meeting agenda for each board meeting. Each meeting agenda shall consist of a consent items agenda (if any), and an action items agenda (if any). The board will carry out its meetings in a consent agenda format to help streamline meeting timelines and to provide time for presentations or discussions at the meetings as appropriate.

(1) Matters part of a "consent agenda" or "consent items agenda" will be subject to a collective voice vote.

(2) Matters part of an "action items agenda" will be subject to a roll call vote except when the bylaws explicitly state otherwise, and may be combined in a single roll call vote if authorized elsewhere in the bylaws.

(3) At meetings of the board, the consent agenda will be moved by the chairperson of the appropriate committee, or, in the chairperson's absence, by a trustee designated by the committee chairperson.

(4) The consent agenda may include (but is not limited to):

(a) All employee-related matters not delegated by the board to college administrative officers, and

(b) Regular academic matters, including without limitation curriculum changes, grants, contracts, gifts, and memberships.

(F) Items that are not part of the consent agenda will be action items, including without limitation the following items:

(1) Items that represent contracts for works of improvement or goods and services, which will be brought forward to action as outlined in college policies and procedures.

(2) Items approving, rescinding or modifying college policy.

(3) Items related to approving agreements or other relationships with external groups or organizations will be individual action items, but need not be roll call votes unless any dollar amounts involved require roll call votes.

(4) Items related to placing a levy on the ballot will be an individual action item.

(G) All action items not specifically designated in this rule as an "individual" action item will, unless otherwise required by law, be combined with similar or related items into a single roll call vote. Such combined vote shall have the same effect as if each action item in the combined vote had been separately called and voted upon. A trustee may, by request, require that any one or more action items be called and voted upon separately. Any such request should, in the interest of efficiency, be made to the board chairperson or appropriate committee chairperson prior to the meeting at which the item is to be considered.

(H) Agendas and support materials will be forwarded to the trustees for review at least one week prior to the scheduled regular meetings. Any trustee who has a question regarding an agenda item should contact the appropriate board committee chairperson or the board chairperson. If additional discussion of the matter is needed to resolve questions or provide more information, the item may be placed on a future agenda or the action item agenda for voting purposes.

Chapter 3354:1-11 Cuyahoga Community College Policies

Ohio Adm.Code 3354:1-11-01 Planning and achievement.

(A) The college shall honor its mission, vision, and values, while setting and achieving its goals. Goals will be achieved by marshalling employees and resources as directed in a strategic plan, while operating in accordance with college policies and procedures.

(B) Policies, and the procedures that operationalize them, establish college-wide rules and processes that unite the college community in a daily effort to accomplish the college's mission, vision, values, and goals. Whereas the strategic plan mobilizes employees and resources through long-term, annual, and individual goals, college policies and procedures direct day-to-day decision making, set behavioral parameters, and establish specific goals.

(C) The college's five-year strategic plan shall facilitate achievement of the college's mission, vision, and values. Annual goals shall flow from the strategic plan. (While goals are adopted and achieved annually, the college's mission, vision, and values are expected to be more enduring.) The college shall pursue operational excellence as it achieves its annual goals.

(D) Operational excellence flows from the establishment and maintenance of a system of policies and procedures. Pursuant to board bylaws and Ohio statute, the board holds authority to operate the college, but delegates some of this authority to the president through policies. The college shall establish and maintain policies and procedures in order to support and catalyze operational efficiency and effectiveness.

(E) The college's mission is, "To provide high quality, accessible and affordable educational opportunities and services - including university transfer, technical and lifelong learning programs - that promote individual development and improve the overall quality of life in a multicultural community."

(F) The college's vision is, "Cuyahoga Community College will be recognized as an exemplary teaching and learning community that fosters service and student success. The College will be a valued resource and leader in academic quality, cultural enrichment and economic development characterized by continuous improvement, innovation, and community responsiveness."

(G) The college's values are, "To successfully fulfill the mission and vision, Cuyahoga Community College is consciously committed to diversity, integrity, academic excellence, and achievement of individual and institutional goals. We are dedicated to building trust, respect, and confidence among our colleagues, students, and community."

(H) Annually, the president shall communicate the following fiscal year's goals to the board.

(I) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the implementation of this policy.

(A) Policies, procedures, departmental directives, and rules.

(1) Policies.

Board policies create a framework within which the president or other officer of the college is directed or authorized to take discretionary action in a specific area. Frequently, policies delegate elements of the board's authority to operate the college. They tell what is required or permitted. They may also indicate why and how much.

(2) Procedures.

College procedures are specific statements of process or means by which policies shall be fulfilled or implemented. Like policies, procedures generally have a broad impact. They may reach beyond any one college department to unify students, employees, multiple college departments, and other individuals or organizations in a common process.

(3) Departmental directives.

Departmental directives are typically minor internal forms, work instructions, guidelines, and other directives that do not have substantive impact beyond one college department. They are not official rules of the college, but rather serve as instructions important to the internal operations of a department.

(4) Rules.

Rules are duly-adopted college policies and procedures. Departmental directives are not rules of the college.

(B) Rulemaking.

Subject to the board's sole authority to adopt, modify, and rescind policies, the president or the president's designee(s) shall lead and coordinate policy and procedure development efforts collegewide. Policies and procedures shall be implemented as a foundation for collegewide operations, and shall be integrated into the college's planning, continuous improvement, and quality assurance efforts. Specifically, the president or the president's designee(s) shall:

(1) Prescribe one or more rulemaking procedures.

(2) Analyze existing federal, state, and local statutes, regulations, and case law for impact on policy and procedure; formulate recommendations; and communicate recommendations to the president and any impacted executive vice president.

(3) Monitor proposed federal, state and local laws and regulations, and developing case law; formulate recommendations; and communicate recommendations to the president and any impacted executive vice president.

(4) Once every five years, lead a comprehensive policy and procedure review project.

(5) Annually, lead a comprehensive policy and procedure review project for at least one chapter of the college's policies and procedures.

(6) Routinely develop recommendations to ensure that the board and the college are complying with Ohio legal requirements relating to policy and procedure development.

(7) Manage state filings in accordance with legal requirements, including section 111.15 of the Revised Code, to the extent applicable.

(8) Participate in the strategic planning, annual planning, and quality assurance planning processes in order to encourage continuous improvement of policies and procedures so that they better support efficient and effective operation of the college toward achievement of its goals.

(9) Periodically participate in training programs that educate college leadership about the legal and operational aspects of policies and procedures.

(10) Periodically audit college operations in order to identify opportunities for improvement in compliance with existing policies and procedures, and for improvement of the policies and procedures themselves.

(11) Communicate policies, procedures, and related matters to students, employees, and trustees in an appropriate manner.

(C) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the implementation of this policy.

Ohio Adm.Code 3354:1-11-03 Commitment to a culture of communication and respect.

(A) The college acknowledges the critical role that open, frank, and orderly communication plays in the achievement of the college's mission, vision, values, and goals. Members of the college community should support and encourage such communications.

(B) Respect towards other individuals and sincere consideration of their ideas is a critical step towards continuous improvement. Employees and students shall act towards others with respect, reasonableness, restraint, order, mutual dignity, and shall sincerely consider others' ideas.

(C) Members of the college community shall be free to support their convictions by means that do not violate others' rights or freedoms and do not disrupt the regular operation of the college or other college activities.

(D) The college acknowledges the importance of an environment that is conducive to learning. The college encourages members of the college community to act in a manner respectful of teachers' and students' needs for an environment conducive to learning.

(E) For the purposes of this rule, a member of the college community is any student, customer, employee, trustee, vendor, visitor, guest or other individual at a college facility or activity.

(F) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-11-04 Conflict of interest policy.

(A) Duties of college officers and trustees.

Each college officer and trustee owes a duty of loyalty to the college, and must avoid conflicts of interest. Conflicts of interest arise in many forms and contexts, and adherence to this policy will not, in and of itself, relieve a college officer or trustee of liability under Ohio ethics laws or other laws governing trustee and officer behavior. It is each college officer's and trustee's individual duty to avoid conflicts of interest, and to disclose conflicts when they arise.

(B) Conflicts of interest.

Conflicts of interest commonly exist when a trustee or officer faces competing loyalties. A conflict of interest does exist when any actual or contemplated transaction or contractual relationship involves the college on one side, and any of the following on the other side:

(1) A college officer or trustee.

(2) A family member of a college officer or trustee.

(3) An organization affiliated with a college officer or trustee.

(C) Required actions.

(1) Upon first learning of a conflict of interest, the college trustee or officer shall fully disclose in writing to the full board and the college president the precise nature of the conflict, including without limitation all relationships and business affiliations that could reasonably be expected to give rise to a conflict of interest involving the college.

(2) College trustees and officers must also timely file any required financial disclosure forms as may be required by applicable law.

(3) Any board resolution involving a conflict of interest shall be treated separately by means of a roll call vote so the conflicted trustee can clearly abstain from voting.

(D) Prohibited actions.

(1) Trustees and officers who have a conflict of interest in any matter being considered by the board (including any committee of the board) must not:

(a) Participate in consideration of the matter, unless and to the extent the board or the college president requests input.

(b) Vote on or debate the matter.

(2) Trustees and officers who have a conflict of interest in any matter being considered by the college must not:

(a) Participate in consideration of the matter, unless and to the extent the college president requests input.

(b) Vote on, recommend, debate, or execute any contract directly relating to, the matter.

(E) Transactions.

A transaction is an event involving an exchange of something of value. Usually (but not always) transactions are memorialized in a purchase order or other written contract. Examples are extensive, and include without limitation real estate leases, procurements of goods, software licensing, and execution of professional services agreements.

(F) Affiliated organizations.

An organization is "affiliated" with a college officer or trustee if a trustee or officer, or a family member of a trustee or officer:

(1) Is an officer, director, trustee, partner, employee, or agent of an organization involved in, or being considered for, a business relationship with the college; or

(2) Is the actual or beneficial owner of more than five percent of the voting equity or controlling interest of such an organization; or

(3) Has any other direct or indirect dealings with such an organization giving rise to a financial interest or fiduciary duty.

(G) Family members.

A "family member" is a spouse, domestic partner, parent, grandparent, grandchild, child, step-child, adopted child, foster child, brother, sister, uncle, aunt, first cousin, nephew, niece, father-in-law, mother-in-law, brother-in-law, sister-in-law, son-in-law, daughter-in-law, half-brother, or half-sister.

(H) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-11-05 Naming opportunities policy.

(A) The college may convey naming rights for its facilities, programs, scholarship, and endowment funds in accordance with this policy and the college's naming opportunities procedure.

(B) Naming recognition for buildings may result from a substantial contribution.

(1) The college may grant naming rights for new and existing buildings.

(2) Naming recognition agreements for buildings shall be subject to approval by the chairperson of the college board, the president of the college, the chairperson of the foundation board and the vice president for resource development and foundation.

(3) Final naming decision for buildings must be approved by the college board.

(C) Naming recognition for facilities other than buildings, including but not limited to classrooms, theatres, etc., equipment, programs, scholarship funds, and endowments, shall remain under the authority of the college and foundation administration as described in the college's naming opportunities procedure.

(D) Nothing in this policy prohibits the college, based upon the recommendation of the president or chairperson of the college board, from naming any facility in honor of an individual who has made or will be making substantial non-economic contributions to the college.

(E) The college president or the president's designee is hereby authorized and directed to take all actions necessary and appropriate to implement this policy.

Ohio Adm.Code 3354:1-11-06 Public records policy.

(A) College compliance with Ohio's Public Records Act.

(1) As a political subdivision of Ohio, Cuyahoga community college district ("College") must comply with Ohio's Public Records Act. Under the Public Records Act, a requester may request to view public records at a college location during regular business hours, or may request to receive copies of public records.

(2) A public record is any document - in paper, electronic (including, but not limited to, e-mail, text messages, instant messages, and databases), or other format - that is created or received by, or that comes under the jurisdiction of the college, and that documents the organization, functions, policies, decisions, procedures, operations, or other activities of the college. Public records of the college are subject to disclosure, unless they are exempt from disclosure under state or federal law.

(3) The college shall adopt a procedure to implement this policy.

(B) Responsibility.

(1) The college shall have a records administrator. The records administrator shall ensure that college records are organized and maintained so that they are readily available for inspection and copying.

(2) The records administrator shall also ensure that records retention schedules are updated regularly and are readily available to the public.

(C) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-11-07 Honorary Degree Nomination Policy.

(A) In recognition of Tri-C's commitment to equality, the board of trustees is committed to the award of honorary degrees to recipients who reflect the diversity of interests, backgrounds, and concerns reflected in the college community and the society and world served by the college.

(B) Suggested candidates to receive an honorary degree from Cuyahoga community college must have a strong current connection to the college either individually or through an organization and should reflect a combination of the following characteristics:

(1) Distinguished personalities who have a significant connection to Tri-C;

(2) Distinguished individuals who have a strong connection to Cleveland or NE Ohio;

(3) Individuals who have exceptional contributions to a specific field or to society in general;

(4) People who have made a significant contribution to higher education;

(5) People whose reputation locally, nationally, or internationally, has enhanced the reputation of Tri-C and serve as an example to its students;

(6) An emeritus faculty member;

(7) Distinguished alumni of Tri-C.

(C) The following individuals are generally excluded but may be considered at the discretion of the board when the individual in question meets the criteria in paragraphs (B)(1), (B)(2), (B)(3), and (B)(5) of this rule.

(1) Employees or degree-earning students of Tri-C;

(2) Current Board of Trustee members;

(3) Current political office holders.

Ohio Adm.Code 3354:1-11-08 Trustee emeritus nomination policy.

(A) Appointment

(1) The trustee emeritus designation is reserved for a retiring board of trustee member who has provided significant, substantive service to benefit cuyahoga community college students and enhance the educational, training and public service mission of the institution. The trustee has established throughout his or her tenure on the board, a record of unmatched commitment through documented acts and deeds to cuyahoga community college. Actively engaged through policy development and implementation, the trustee has enabled the college to accomplish its mission and strategic priorities through innovative programs and operations.

(2) It is expected, also, that the trustee has demonstrated a history of professional accomplishment, national and state board/college representation and community engagement that would warrant external recognition and that would bring honor and distinction to the individual and the college.

(3) The trustee emeritus designation is to be awarded at the conclusion of the final term of the board member at the last official meeting or immediately thereafter. The recipient will be deemed ineligible for re-appointment to the cuyahoga community college board of trustee by the appointing authorities in the future.

(B) Emeriti qualifications. Candidates for the trustee emeritus must demonstrate a history of distinguished and noteworthy commitment to the college and community in the following ways:

(1) Serve on the board a minimum of fifteen consecutive years or three terms.

(2) Attend, at a high ratio, board and committee meetings, retreats, state and national meetings, and other activities that foster board engagement, development and active participation.

(3) Known as an advocate for the college and its students at the local, state, and national levels through attendance and visible involvement in student-centered initiatives.

(4) Exhibit a dedication to students and the college by attending and engaging in college events, including but not limited to commencements, convocations, educational programs, student activities, college foundation benefits, re-accreditation visits, and institutional membership groups such as the league of innovation.

(5) Contribute monetarily in support of college initiatives and the college foundation.

(6) Exemplify public decorum and demeanor expected of a trustee and representative of the college.

(7) Achieve in professional, civic and community roles.

(C) Nomination. Eligibility for trustee emeriti is assessed by the executive committee of the board of trustees in consultation with the college president to ensure that candidates meet all the qualifications noted above. If it is determined that all criteria are met or exceeded, a resolution is prepared and presented for a vote by the cuyahoga community college board of trustees.

(D) Emeritus privileges. The following privileges will be afforded the trustee emeriti:

(1) Photograph with an entitled "trustee emeriti" plaque is displayed in the cuyahoga community college board room.

(2) The trustee emeritus name is included in publications along with the names of standing members of the board of trustees.

(3) Special guest at college and trustee events and activities, where appropriate.

(4) Invitation to participate in ad hoc groups or committees where expertise may be beneficial.

(5) Receive college publications to be kept abreast of college initiatives.

Ohio Adm.Code 3354:1-11-09 Policy on student success and completion.

(A) As the Cuyahoga community college board of trustees reaffirms our commitment to access and the still relevant "open door" mission of community colleges, we believe that it is our institutional imperative to significantly increase the rate of completion of students admitted to the college.

(B) The board of trustees of Cuyahoga community college will be actively engaged in this effort developing policy and directing resources necessary for supporting evidence-based institutional culture focused on student success and completion.

(C) Trustees must fully understand and embrace the complexities of the completion challenge, and understand that to succeed in this we will require real change. To this end, the trustees instruct the president to develop for their approval a comprehensive plan with specific goals, benchmarks, strategies and timelines.

(D) The plan will require bold, innovative and aggressive action by the trustees, the president, faculty and staff and will include the support and participation of every department and division of the college.

(E) Success and completion will be the highest priority of the board and each of its committees.

Chapter 3354:1-20 Finances and Investments

Ohio Adm.Code 3354:1-20-01 Financial Policy.

(A) Budget authorization

Annually, the board shall:

(1) Approve a five-year financial plan that forecasts all revenues and expenditures for the college. This financial plan shall include the five-year enrollment forecast as a basis for projecting tuition revenues and associated expenses; and

(2) Appropriate all expenditures for the upcoming fiscal year.

(B) Receipt and disbursement of all funds.

(1) Pursuant to section 3354.06 of the Revised Code, the treasurer shall receive and, at the direction of the board, disburse all funds of the college.

(2) All funds of the College must be deposited upon receipt in an authorized bank depository. All funds of the college, and all earned income, must be recorded in the official books of accounts of the college.

(C) Budget monitoring

All revenues and expenditures shall be monitored on a monthly basis. This analysis shall use historical trend data and current year assumptions to project financial position and ensure adequate use of resources.

(D) Investment of excess cash balances

The college may invest its excess cash balances in securities specifically permitted by division (B) of section 3354.10 and 135.45 of the Revised Code, an in such other securities as may be permitted by law. All college investments in securities shall be undertaken with the primary objective of ensuring preservation of principle. Subject to the foregoing, the college's securities investment decisions shall seek to maximize returns on excess cash balances of the college, and to provide sufficient liquidity.

(E) Resource development

The college shall regularly seek and accept gifts, grants, bequests and devises. Resource development shall ensure gifts, grants, bequests and devises align with the college's mission, vision and values and strategic priorities. The treasurer, or his or her designee, shall ensure the financial terms of any grants are adhered to and financial reports are submitted timely.

(F) Audit

The college will engage in annual financial audits conducted by the auditor of state or the auditor's designee.

(G) Debt management

Criteria shall be established for structuring, issuing, evaluating and otherwise managing debt.

(H) Authority for fiscal management

The treasurer is authorized and directed to develop and issue college-wide financial systems and processes, subject to the continuing direction of the president and the board.

(I) Implementation

The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-20-02 Frees and refunds policy.

(A) Instructional tuition for credit courses.

(1) The board will set credit instructional tuition and general fees.

(2) The college shall maintain a separate instructional tuition and general fee structure for: students who are residents of the district, students who are residents of Ohio but not of the district, and students who are not residents of Ohio.

(3) Tuition rates shall be regularly reviewed and updated in accordance with Ohio law.

(B) Supplemental, incidental and institutional fees.

The college may establish supplementary course and incidental fees to cover certain costs of goods and services related to the education process. The appropriateness of such fees are to be regularly reviewed and updated accordingly. Such fees are to be charged equally to all students regardless of their residency status, credit or audit status, or employment status with the college; except that senior citizens participating in the free tuition course audit program shall not be charged such fees.

Institutional fees are charged to all students as determined by the number of credit hours. The fee is designed to provide students with unlimited access to all campuses, recreation facilities, technology learning centers, libraries and campus special events.

(C) Fees for non-credit courses, training and services.

Fees charged by the college for non-credit courses, training and services shall be established in consideration of college goals and market demand.

(D) Refunds for credit and non-credit courses.

Refunds for students participating in federal financial aid programs may be determined by federal law. Except to the extent refunds are determined by law, the following rules apply:

(1) For academic credit and non-credit courses, refunds of tuition and of instructional, general and supplemental fees shall be made in accordance with a refund schedule, which the college shall regularly promulgate.

(2) No refunds shall be granted if a student is dismissed from the college for disciplinary reasons.

(E) Student parking fees.

Parking fees will be charged to students who use college parking facilities.

Ohio Adm.Code 3354:1-20-03 Operations policy.

(A) Facilities use by non-college groups.

College facilities are intended for the educational functions of the college. When facilities are not required for college functions, the college may permit non-college groups to use college facilities, subject to reasonable time, place, and manner restrictions. Such groups must agree to pay all costs incidental to such use, including without limitation costs relating to security, maintenance, insurance, custodial, and audio-visual support. A security deposit shall be required prior to the use of college facilities.

(B) On-site vendor employees.

Vendors and their employees are required to adhere to the same levels of conduct and courtesy as are college employees, and are subject to applicable college policies and procedures.

(C) Use of college vehicles.

"College vehicles" are any vehicles owned or leased by the college. College vehicles may be driven only by authorized drivers. An official list of all authorized drivers shall be maintained by the college.

(D) Leasing broadcast tower facilities.

The college will consider proposals for the leasing of tower space and related facilities on college-owned or controlled broadcast towers.

(E) Soliciting, canvassing, and selling at college locations.

No individual or organization shall, at any college location, engage in soliciting, canvassing, or selling of any kind. The foregoing does not apply to individuals or organizations authorized by the district president or the president's designee, or to college employees acting within the course and scope of employment.

(F) Distributing and posting written materials.

Except for individuals or organizations acting within such reasonable time, place, and manner restrictions as may be required by the college, no individual or organization may, at any college location, distribute or post any kind of notices, circulars, signs, or other written materials.

(G) Disposal of surplus property.

The college may determine property to be obsolete or surplus. The executive vice president/treasurer shall maintain a standard process for disposal of such property.

(H) Parking fees.

(1) The college shall charge fees for the use of college parking facilities, consistent with a parking fee schedule established by the board.

(2) At the discretion of the district president, net proceeds from special events parking shall be allocated to the Cuyahoga community college Foundation for scholarships and other educational purposes, or to the college.

(I) Implementation.

(A) The college is firmly committed to protecting the environment it shares, and the health and safety of all members of the college community. The college shall:

Ohio Adm.Code 3354:1-20-05 Alcohol, drigs. and tobacco policy.

(A) Alcohol.

(1) The sale, service, and consumption of alcohol at any college location or function shall in all instances conform to all requirements of applicable law.

(2) The college shall maintain an approval process for the sale and service of alcohol.

(3) Public funds shall not be used to purchase alcohol (except that public funds may be used to purchase alcohol required for a college-approved curriculum).

(B) Drug-free campus and workplace.

(1) The unlawful manufacture, distribution, dispensation, possession, or use of drugs or alcohol is prohibited on college property, anywhere the college is conducting business, and at all college-sponsored activities. A violation of the foregoing may also be a violation of Schedule I through V of Section 202 of the federal Controlled Substances Act, Chapter 2925. of the Revised Code, and of local laws. Violations of these federal, state, and local laws may carry severe penalties including but not limited to incarceration and fines.

(2) The health risks associated with the use of illicit drugs and the abuse of alcohol include without limitation, an increased risk of AIDS, hepatitis, heart disease, cancer, and other diseases; birth defects, respiratory failure and strokes; unwanted pregnancies; injuries from accidents and deliberate acts of violence; and death.

(3) The college shall continue to maintain a drug-free awareness program, including specific drug and alcohol counseling treatment and rehabilitation programs for students and employees. Examples of such programs may include: Tri-C Cares, Health Services, and the Alcohol Drug Abuse Program Team (ADAPT).

(4) The college will conduct a biennial review of its drug-free awareness program to determine its effectiveness, implement any changes, and ensure that sanctions are consistently enforced.

(5) Employees working under the provisions of a federal grant or contract must be given a copy of the college's drug-free workplace policy; must be notified that, as a condition of their employment, they will abide by the policy; and must report to the college's internal legal counsel any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such conviction.

(6) Employees and students will be reminded annually of these drug-free campus and workplace requirements.

(C) Tobacco.

(1) The college premises shall be tobacco free, thus supporting a healthy environment for all who are on the grounds of any college locations.

(2) This policy applies to all individuals, including but not limited to employees, students and visitors who may be located inside or outside of any buildings, residences, or parking lots on the grounds of any of our college locations.

(3) Tobacco is defined as all products derived from, or containing tobacco, including and not limited to:

(a) Cigarettes (e.g. cloves bidis, kreteks)

(b) Cigars and cigarillos

(c) Hookah smoked products

(d) Pipes and oral tobacco (e.g. spit and spitless, smokeless, chew, snuff)

(e) Nasal tobacco

(f) Electronic cigarettes and vapes or any other product intended to mimic tobacco products and/or deliver nicotine other than for the purpose of cessation, or that contains tobacco flavoring.

(4) It is the responsibility of all students, faculty, staff and visitors to observe, adhere to and respect the college's tobacco free policy. Students, faculty and staff are encouraged and empowered to respectfully inform others about the policy in an ongoing effort to support the college's goal of becoming tobacco free and improving individual health and well-being.

(D) Violations.

(1) A violation of this policy by a student may result in disciplinary action (which may include expulsion), and referral for prosecution.

(2) A violation of this policy by an employee may result in disciplinary action (which may include termination), and referral for prosecution.

(E) Implementation.

The president or the president's designee is hereby directed to take all steps necessary and appropriate for the implementation of this policy.

Ohio Adm.Code 3354:1-20-09 Identity theft policy.

(A) Purpose and leadership.

(1) Identity theft is a serious concern in modern society. The college creates, obtains, and stores personally-identifiable financial and other sensitive information, and desires to ensure appropriate measures are taken to prevent identity theft involving such information. Therefore, the college shall maintain an active identity theft program in accordance with federal trade commission regulations enacted at 16 C.F.R. 681 et. seq. (often referenced as the "red flag rule"). This identity theft policy shall be supported by an "identity theft procedure."

(2) The vice president for administration and finance shall serve as "program administrator," leading development, implementation, and oversight of the identity theft program.

(B) Identifying red flags.

(1) The program should identify red flags for covered accounts and incorporate those red flags into the program.

(a) The program should incorporate the following risk factors in identifying relevant red flags for covered accounts:

(i) The types of covered accounts offered or maintained by the college.

(ii) The methods provided by the college to open covered accounts.

(iii) The methods provided by the college to access covered accounts.

(iv) The college's experience, if any, with identity theft.

(b) The program should incorporate appropriate red flags from relevant experiences and sources, including without limitation:

(i) Incidents of identity theft previously experienced.

(ii) Methods of identity theft that reflect changes in risk.

(iii) Regulatory or professional guidance.

(c) As appropriate, the program shall include relevant red flags from the following categories of risk factors:

(i) Alerts, notifications, or other warnings received from consumer reporting agencies or service providers, such as fraud detection services.

(ii) The presentation of suspicious documents.

(iii) The presentation of suspicious personal identifying information.

(iv) The unusual use of, or other suspicious activity related to, a covered account.

(v) Notice from customers, employees, students, victims of identity theft, law enforcement authorities, or other persons regarding possible identity theft in connection with covered accounts.

(C) Detecting and responding to red flags.

The college's identity theft procedure should address the detection of red flags in connection with the opening of new covered accounts and existing covered accounts. The identity theft procedure should provide for appropriate responses to detected red flags to prevent and mitigate identity theft. The responses should be commensurate with the degree of risk posed.

(D) Updating the identity theft program.

The college should periodically, and at least annually, update the identity theft program (including the identity theft policy and procedure), in accordance with appropriate factors, which may include:

(1) The experiences of the organization with identity theft.

(2) Changes in methods of identity theft.

(3) Changes in methods to detect, prevent and mitigate identity theft.

(4) Changes in the types of accounts that the organization offers or maintains.

(5) Changes in the business arrangements of the organization, including without limitation, alliances, joint ventures, and service provider arrangements.

(E) Definitions.

(1) "Covered accounts" are the college's deferred payment plans, emergency loans, perkins loans, and my tri-c card accounts.

(2) "Identifying information" is "any name or number that may be used, alone or in conjunction with any other information, to identify a specific person," including without limitation: name, address, telephone number, social security number, date of birth, government issued driver's license or identification number, alien registration number, government passport number, student identification number, employee identification number, computer's internet protocol address, and routing code.

(3) "Identity theft" is a "fraud committed or attempted using the identifying information of another person without authority."

(4) "Red flag" means a "pattern, practice, or specific activity that indicates the possible existence of identity theft."

(F) Methods for administering the program.

In administering the identity theft program, the program administrator shall be responsible for:

(1) Training of college staff on the program.

(2) Requiring and reviewing reports on compliance with this program. The identity theft procedure should include appropriate details about this reporting process.

(3) Leading prevention and mitigation efforts in particular circumstances.

(4) Monitoring and ensuring college compliance with the identity theft policy and procedure.

(5) Overseeing the activities of service providers performing activities related to covered accounts to ensure that such activities are conducted pursuant to reasonable policies and procedures designed to detect, prevent, and mitigate the risk of identity theft.

(G) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-20-10 Zero Tolerance for Violence on College Property Policy.

(A) Zero tolerance

(1) The college is committed to creating and maintaining a working and learning environment, which is free from violence. Understanding and mutual respect toward all individuals are essential elements to excellence in teaching and learning, to the existence of a safe and healthy workplace, and to the maintenance of a healthy campus culture which serves the needs of the community. The college prohibits violent acts or threats of violence.

(2) Any employee, student or visitor who commits a violent act, or threatens to commit a violent act, is subject to disciplinary action and or civil or criminal prosecution, as appropriate.

(3) The college has zero tolerance for violence against or by any member of the college's workforce or any other persons on college property. Any person who makes threats, exhibits threatening behavior, or engages in violent acts on college property shall be subject to immediate removal from the premises.

(4) For the purpose of this policy, violence and threats of violence include but are not limited to:

(a) Any act that harms or endangers the safety of oneself or another, or

(b) Any physical or verbal threat, behavior, or action which is interpreted by a reasonable person to carry the potential:

(i) To harm or endanger the safety of others;

(ii) To result in an act of aggression;

(iii) The intentional damage/destruction or threat of damage/destruction of property owned, operated, or controlled by the college;

(iv) Making harassing or threatening telephone calls, or sending harassing or threatening letters or other forms of written or electronic communications; intimidating or attempting to coerce another to do wrongful acts, as defined by applicable, law, administrative rule, or policy that would affect the business interests of the college;

(v) The willful, malicious and repeated following of another person, also known as "stalking," and making of a credible threat with intent to place the other person in reasonable fear for his or her safety;

(vi) Making a suggestion or otherwise conveying that an act to injure persons or property is "appropriate," without regard to the location where such suggestion occurs;

(vii) Possession of a weapon while on college property (unless specifically approved as a job-related requirement or in designated parking areas in accordance with the concealed carry weapons law of the state of Ohio as set forth in Chapter 2923. of the Revised Code); or

(viii) Committing acts of violence motivated by, or related to, race, age, color, national origin, religion, sexual orientation, sex, disability, marital status, sexual harassment or domestic violence. Violence can include more than inflicting physical harm to others or self. Violent behavior also consists of threats and acts of aggression. Some examples of threats are remarks of revenge and abusive and obscene statements. Acts of aggression are abusive behavior, such as stalking, pounding of fists, stomping, swiping at objects, and tampering with property, in an attempt to intimidate, inflict harm or destroy property.

(B) The president or his/her designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-30-04 Board student scholar policy.

(A) Purpose. Each year, the board of trustees will have a board student scholar. The board student scholar is intended to help the board receive perspectives and other information from students about their needs, suggestions, and concerns. The role is also to provide board student scholars with a learning opportunity related to organizational governance and leadership. The board student scholar is not a trustee, has no voting rights, and does not participate in decision-making or executive sessions.

(B) Duties. The board student scholar will attend the following meetings and events: meetings of the board of trustees and its academic and student affairs committee, student retreats, college leadership development classes, student government meetings, and joint student council meetings. Subject to college policies relating to procurement and expense reimbursement, the college will cover costs associated with the board student scholar's participation in these meetings. During joint student council meetings, the board student scholar will gather issues from the four campuses relevant for board discussion. The board student scholar will have opportunities to present such issues to the board or its committees.

(C) Selection and criteria. The board student scholar will be selected by the joint student council during the spring semester. Students must be 18 years or older to be selected as a board student scholar representing the student body. Each year, the board student scholar will be chosen from the Eastern, Metropolitan, Western, or Westshore campus student body on a rotating basis. The board student scholar must be and remain currently enrolled, and have and maintain at least a 2.50 grade point average. If a board student scholar loses such status, he or she will be removed by the college, in which event the joint student council must select a replacement from the same campus for the remainder of the academic year. The board student scholar will serve a term of one academic year and may not serve multiple terms. The board student scholar must have successfully completed at least twenty semester credit hours or its equivalent by the beginning of his/her term as board student scholar with no maximum accumulated credit hours each semester. The board student scholar must be enrolled in at least eight credit hours each semester, and have at least one year of student leadership experience at Cuyahoga Community college. Except for work-study students, the board student scholar may not be an employee of the college.

(D) Implementation. The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-30-05 Collegewide participatory governance policy.

(A) The college acknowledges the critical role that open, frank, and orderly communication plays in the achievement of the college's mission, vision, values, and goals. To encourage and foster such communication, the college shall maintain a governance system.

(B) The governance system shall include committees charged with providing advice and recommendations on behalf of various college constituencies. Each committee will elect its own chair and secretary and will function as a committee for two years.

(C) Committees shall receive annual charges from the college president. Committees may receive special charges from the president related to particular issues that need timely attention. Committees may also develop their own charges, subject to the prior approval of the president.

(D) The college acknowledges that the full-time faculty has formed a "Faculty Senate" through which the full-time faculty prefers to communicate certain advice and recommendations to the governance system.

(E) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-30-06 Policy on human subjects research.

(A) The college may engage in research involving human subjects for the purpose of systematic investigation designed to develop or contribute to the advancement of knowledge. All such research must comply with this policy, even if it:

(1) Is only partially conducted by the college

(2) Is only partially funded by the college

(3) Is not funded or conducted by the college, but the college permits or directs its employees or students to participate as researchers or subjects

(B) Human subjects research must be conducted in a manner consistent with federal and state laws and regulations (including without limitation 45 C.F.R. Part 46, as amended from time-to-time), and may be conducted in a manner consistent with other generally-accepted professional standards governing the research.

(C) In conducting human subjects research, the college will adhere to the principles of autonomy, beneficence, and justice:

(1) Autonomy provides subjects the information, time, respect and opportunity to make informed decisions regarding participation in research with special regard for particularly vulnerable populations. No research may be conducted using any person unless that person has given the college a signed written consent form.

(2) Beneficence provides for a thoughtful balance of benefits and risks that protects subjects from harm and regards their well-being. The college shall establish an institutional review board to review and approve proposed research on human subjects prior to the start of any research it partially or wholly conducts or funds. The college will seek to minimize risks of harm to subjects in such research.

(3) Justice provides for fair and unbiased distribution of benefits and burdens of research as well as impartial and equitable subject selection.

(D) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-30-07 Tenure Policy.

(A) Tenure is awarded in recognition of faculty competence to the college's instructional faculty, counselors and librarians. Tenure, by tradition, is evidence of an academic institution's support of academic freedom and the professional responsibility of the individual to whom tenure is awarded.

(B) Tenure, the continuous appointment to employment, awarded by the board of trustees in recognition of faculty competence, is the college's most effective means for establishing a climate of academic freedom and professional responsibility.

(C) All tenure-track faculty shall become eligible for tenure after five years of service to the college during which they have served over fifty per cent of their annual contractual time in a teaching capacity. Teaching capacity is defined by the college as: classroom instruction, college librarian, or counseling. Additionally, in order to be granted tenure, tenure-track faculty must meet the criteria governing eligibility for the rank of assistant professor. Further, in order to be granted tenure, tenure-track faculty must have demonstrated teaching ability, creative achievement, academic integrity, and professional service to the college. Once awarded, tenure shall be continuous until the retirement of the faculty member or the termination of the individual's contract.

(D) Should a faculty member be denied tenure at the time of eligibility, the college shall provide the member with written reasons for the denial.

(E) A tenured faculty member may be terminated due to retrenchment or just cause.

(F) The executive vice president for academic and student affairs, using appropriate governance guidelines, is authorized to develop and implement procedures necessary to carry out this policy.

Ohio Adm.Code 3354:1-30-08 Policy on faculty evaluation.

(A) In order to recognize, maintain, and improve the total effectiveness of the faculty of the College, the performance of all faculty members employed by the College will be evaluated in writing in accordance with the provisions of this policy. The policy is intended to provide for the assessment of individual performance and to encourage improvement in achieving the educational goals of the College. The evaluation system provides for improvement of the quality of instruction, for encouragement of professional growth and development, and for informed personnel decisions.

(B) The written evaluations prescribed herein will be considered prior to personnel decisions including, but not limited to, reassignment, contract renewal for non-tenured faculty, termination, and the granting of academic rank and tenure.

(C) The evaluation procedures of the College will provide for multiple sources of information on faculty performance. The sources include evaluation by self, peers, students, supervisors, and other appropriate sources. The combination of information sources as defined by CCC-AAUP contract and performance categories for each faculty member's evaluation will be agreed upon between the faculty member and his/her immediate supervisor, but at a minimum will include evaluation by the immediate supervisor and the faculty member's students. Other sources agreed upon by the faculty and immediate supervisor may also be included. In accordance with the procedure, any forms used to collect such information will be standardized across the College.

(D) Written evaluations will be required as follows:

(1) A written evaluation of the performance of each full-time tenured faculty member will be conducted by the immediate supervisor, or the appropriate dean/director, once every three academic years.

(2) A written evaluation of the performance of each full-time tenure track faculty member will be conducted by the immediate supervisor, or the appropriate dean/director, and shall occur twice annually during the first two academic years of the probationary period and once annually during the remaining academic years of the probationary period.

(3) A written evaluation for each full-time lecturer will be conducted by the immediate supervisor at least twice per year, at least once in the first semester and at least once during the second semester, after the first, agreed to by the lecturer and the supervisor.

(4) A written evaluation of each part-time lecturer, based on classroom observance and student evaluations, will be conducted by the immediate supervisor, or the supervisor's designee, during the initial semester of service and, thereafter, at least once every two academic semesters during which the part-time lecturer performs services for the College. (This provision does not apply to full-time tenure or tenure-track faculty or full-time lecturers who perform additional assignments as part-time lecturers.)

(E) Original copies of written evaluation reports for full-time faculty will be kept in the district office of human resources. Each faculty member will be provided with a copy of his/her evaluation by the supervisor before it becomes an official College record. The faculty member may prepare a written response to the evaluation and may request a re-evaluation. If such written response is submitted, it will be made part of the official College record. Disagreements arising from faculty evaluations will be resolved according to CCC-AAUP contract grievance procedure.

(F) After completion of each written evaluation report, each tenured and tenure track faculty member will submit a professional development plan to their dean/director. The preparation and implementation of the plan will be the responsibility of the faculty member in conjunction with the dean/director. If requested, the office of teaching, learning, and academic professional development will provide the appropriate support for this activity.

(G) The office of the access, learning and success is responsible for approving all standard forms used in collecting faculty performance information consistent with provisions of the contract between the board of trustees and the CCC chapter of the AAUP.

(H) The campus presidents and vice presidents of college-wide programs are responsible for ensuring that all faculty members are evaluated according to the provisions of this policy.

(I) The executive vice president for access, learning, and success, and the executive director of access, learning and success are hereby directed to establish procedures and take all other steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-30-09 Policy regarding the promotion of available suicide prevention programs on and off campus.

(A) Purpose

(1) The college is committed to providing appropriate mental health resources and information to its students, faculty, and staff. This policy is intended to provide resources to the college community in the interest of deterring, preventing, and discouraging suicide attempts by individuals struggling with suicidal ideations. This policy and the requirements contained within are in accordance with section 3345.37 of the Revised Code.

(B) Suicide prevention program

(1) The college will provide access to suicide prevention information and resources to the collegewide community and develop and implement communication and outreach plans as follows:

(a) Crisis intervention access - including information for national, state, and local suicide prevention hotlines;

(b) Mental health program access - including information on the availability of local mental health clinics, health services, and counseling services;

(c) Multimedia application access - including crisis hotline contact information, suicide warning signs, resources offered, and free-of-cost applications;

(d) Student communication plan - including plans for outreach regarding educational and outreach activities on suicide prevention; and

(e) Postvention plan - including a strategic plan to communicate effectively with students, staff, and parents after the loss of a college community member(s) to suicide.

(2) The following information must be posted on the college's web site:

(a) Crisis intervention access - including information for national, state, and local suicide prevention hotlines;

(b) Mental health program access - including information on the availability of local mental health clinics, health services, and counseling services; and

(c) Multimedia application access - including crisis hotline contact information, suicide warning signs, resources offered, and free-of-cost applications.

(3) All incoming students must be provided with:

(a) Information about mental health topics, including depression and suicide prevention resources available to them; and

(b) Notice of available mental health services and other support services, including student-run organizations for individuals at risk of or affected by suicide.

(C) The vice president for access and completion or the vice president for access and completion's designee is responsible for the implementation and oversight of this policy.

Ohio Adm.Code 3354:1-40-02 Employment of relatives policy.

(A) The college may hire and retain employees who are relatives of other employees. However, an individual may not be assigned or accept employment in a position in which supervisory authority or responsibility directly affecting that position is provided by a relative of the individual.

(B) Should a relative relationship that violates paragraph (A) of this policy arise after employment has begun, that situation must be promptly remedied.

(C) An employee will neither initiate nor participate in decisions involving a direct benefit to relatives including without limitation decisions about initial employment, termination, evaluation, promotion, compensation, benefits, and leaves of absence.

(D) For the purposes of this policy, "relative" includes anyone related to an employee as a spouse, parent, grandparent, grandchild, child, brother, sister, uncle, aunt, first cousin, nephew, niece, father-in-law, mother-in-law, brother-in-law, sister-in-law, son-in-law, daughter-in-law, half-brother, half-sister, legal guardian or anyone who resides at the same address as an employee.

Chapter 3354:1-42 Policies on Discrimination and Harassment

Ohio Adm.Code 3354:1-42-01 College policy on affirmative action, inclusive excellence, equal opportunity, discrimination, and harassment.

(A) Commitments

The college embraces human diversity and is committed to affirmative action, inclusive excellence, and equal opportunity. The college is committed to eliminating discrimination and harassment in the workplace and academic environment. These commitments are moral imperatives consistent with an intellectual community that celebrates individual differences, diversity, and meaningful individual freedom to pursue professional and educational goals. In many circumstances, these commitments also represent legal requirements.

(B) Discrimination

Employment and academic discrimination against any individual on the basis of age, ancestry, color, disability, military status, national origin, race, religion, sex, sexual orientation, gender identity and expression, pregnancy, veteran status and genetic information is prohibited.

(C) Affirmative action and diversity

The college is committed to maintaining a diverse workforce as it continues to pursue the highest quality employees. It is the responsibility of every employee to foster a college environment that embraces human diversity and is committed to affirmative action and equal opportunity.

(D) Inclusive excellence

The fundamental premise of inclusive excellence is the intentional integration of diversity into the core aspects of the institution, including academic priorities, leadership, decision-making, day-to-day operations, and organizational cultures. The college is committed to diversity and inclusion and therefore seeks to focus on greater diversity, equity, inclusion, and accountability at every level.

(E) Harassment

(1) Harassment, in general

Harassment against any individual on the basis of age, ancestry, color, disability, military status, national origin, race, religion, sex, sexual orientation, gender identity and expression, pregnancy, veteran status and genetic information is prohibited. Conduct whether verbal, non-verbal, or physical may constitute harassment if it relates to any such classification and creates an intimidating, hostile, or offensive work or academic environment that unreasonably interferes with work or academic performance or negatively affects an individual's employment or academic opportunities.

(2) Forms of harassment, in general.

Harassment occurs in many forms, and an exhaustive list cannot be created. Harassment can occur between any individuals associated with the college - for example, an employee and a supervisor; coworkers; faculty members; a faculty, staff member, student, or employee and a customer, vendor, or contractor; or a student and a faculty member. Harassment in the workplace or academic environment may manifest itself in many ways, including without limitation jokes, slurs, derogatory expressions, graphics, cartoons, objects, e-mails, or comments.

(3) Sexual harassment

(a) Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature generally constitute unlawful sexual harassment when:

(i) Submission to sexual conduct is an explicit or an implicit term or condition of an individual's employment or of a student's status in a course, program, or activity;

(ii) Submission to or rejection of sexual conduct by an individual is used as the basis for any employment or academic decision affecting that individual; or

(iii) The sexual advances, requests for sexual favors, and/or verbal conduct of a sexual nature have the purpose or effect of substantially interfering with an individual's work or academic performance or create an intimidating, hostile, or offensive working or learning environment.

(b) The following are examples of unwelcome conduct which may constitute sexual harassment:

(i) Requests for sexual favors

(ii) Physical touching

(iii) Lewd or suggestive remarks

(iv) Requests for dates or meetings after work or class

(v) Demands for sexual favors in return for salary increases, promotion, other benefits of employment, grades or letters of recommendation

(vi) Sexually explicit magazines, picture, jokes or e-mails displayed or told in the work area or the classroom

(vii) Questions or remarks about the sexual body parts of an individual

(F) Any managerial or supervisory level employee who learns of a violation of this policy must immediately report the violation to the office of employee relations.

(G) The college shall conduct regular training to encourage compliance with this policy.

(H) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the implementation of this policy.

Chapter 3354:1-43 Policies on Corrective Action

Ohio Adm.Code 3354:1-43-01 Professional development and performance evaluation policy.

(A) The college is committed to supporting academic and administrative excellence through recruitment, selection, and development of employees. In support of this commitment, the college shall foster employee development. This may include providing professional exchange programs, consulting leave, remission of fees, professional improvement leave, and other methods. It shall include a regular employee performance evaluation system.

(B) The college shall continue to operate a comprehensive performance evaluation system that provides:

(1) Appraisals of employee performance on an ongoing basis with written evaluations;

(2) Employee participation in the establishment of goals and objectives;

(3) Evaluations based upon mutually established objectives.

(4) The availability, at the discretion of supervisors and the office of human resources, of performance improvement plans. Such plans may be developed with the office of human resources when a supervisor notifies the office that an employee's performance is inadequate. Performance improvement plans may include a probationary period of employment.

(C) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

(A) Employees must exhibit a high degree of personal integrity at all times. This requires sincere respect for the rights of others, and refraining from any behavior that might be harmful to one's self, other members of the college community, or the college. Employees must also refrain from behavior that would cast the college in an unfavorable light in the view of the communities served by the college.

(B) In addition to behavior inconsistent with paragraph (A) of this policy, the following conduct is specifically prohibited:

(1) Threatening, attempting, or committing physical violence against any person.

(2) Preventing, impeding or disrupting, or attempting to prevent, impede or disrupt, any college activity.

(3) Endangering the personal health, safety, and welfare of the employee or any other person.

(4) Violating, while on or in college facilities or vehicles, any municipal, county, state, or federal statute or ordinance.

(5) Gambling for money or other things of value on or in college facilities.

(6) Using language that is degrading or abusive to any person.

(7) Furnishing false information to the college.

(8) Excessive unauthorized absenteeism or tardiness.

(9) Unauthorized use of college supplies or equipment for personal purposes.

(10) Violation of any college policy or procedure.

(11) Insubordination.

(12) Failure to maintain a license, certification or other required qualification.

(13) Being under the influence of alcohol or a controlled substance, or the possession of a controlled substance, while on duty.

(14) Absence without acceptable notification.

(15) Inappropriate handling of any college document or record, including without limitation tampering with personnel files or information contained within such files in any manner that seeks personal benefit, or permits others to benefit personally, or knowingly permits the inclusion of false, inaccurate or misleading information.

(C) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the implementation of this policy.

(A) This policy applies to all full and part-time employees unless specifically excluded or limited by the explicit provisions of a collective bargaining agreement.

(B) Should an employee's performance, work habits or behavior become unsatisfactory in the judgment of the college, based on a violation of accepted standards of conduct or college policies, procedures, rules or regulations, that employee will be subject to corrective action, up to and including dismissal.

(C) Due process will be provided to employees prior to the suspension, disciplinary demotion or dismissal of an employee by the college; except that if, in the judgment of the college, earlier action is necessary for the protection of person or property, then due process may occur after the suspension, disciplinary demotion or dismissal.

Ohio Adm.Code 3354:1-43-04 Assignment and reduction in force of non-bargaining employees policy.

(A) The president shall ensure that administrative and support staff personnel are assigned to duties that are consistent with the efficient management and economic welfare of the college. The president may determine the assignments of any non-bargaining employees.

(B) The president may initiate a reduction in force during times of financial exigency or administrative or programmatic reorganization.

(C) The president, through the office of human resources, shall exercise and execute actions related to non-bargaining employee reductions in force including appropriate consultation with the parties and units affected by such actions.

(D) This policy does not apply to situations covered by any collective bargaining agreement.

(E) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-43-05 Personal Information system policy.

(A) The college operates one or more personal information systems regulated by chapter 1347. of the Revised Code. The executive vice president of administration is directly responsible for the system. For the purposes of this policy:

(1) "Personal information" means any information that describes anything about a person, or that indicates actions done by or to a person, or that indicates that a person possesses certain personal characteristics, and that contains, and can be retrieved from a system by a name, identifying number, symbol, or other identifier assigned to a person.

(2) "System" means any group of related records maintained by the college and from which personal information can be retrieved by the name of the person or by some identifying number, symbol, or other identifier assigned to the person. System includes records that are manually stored and those stored through the use of electronic data processing equipment.

(B) The college will inform, in writing, all employees responsible for the operation or maintenance of the system or for the use of personal information in a system of the existence of chapter 1347. of the Revised Code and of this policy.

(C) An individual who initiates or contributes to any disciplinary or other punitive action against another individual who brought to the attention of appropriate authorities, the press, or any member of the public, evidence of unauthorized use of information contained in a personal information system will be subject to disciplinary action pursuant to the college's corrective action procedure.

(D) Any individual who is asked to supply personal information for a college system will be informed, in writing, whether or not the individual is legally required to supply the information or that the individual may refuse to supply the information.

(E) The accuracy, relevance, timeliness and completeness of personal information in a system will be monitored and maintained.

(F) The college shall take reasonable precautions to protect personal information in a system from unauthorized modification, destruction, use, or disclosure.

(G) The college will periodically review its personal information systems and eliminate personal information that is no longer necessary and relevant, pursuant to applicable record retention schedules.

(H) Upon request from and proper identification of an individual who is the subject of personal information in a system, the college shall:

(1) Inform the person of the existence of any personal information in the system of which the person is the subject.

(2) Permit the person or his legal guardian or an attorney who presents a signed written authorization made by the person to inspect all personal information in the system of which the person is the subject.

(3) Inform the individual about the types of uses made of the personal information including the identity of any users usually granted access to the system.

(4) Disclose upon request, medical, psychiatric, or psychological information to a person who is the subject of the information or to his legal guardian, unless a physician, psychiatrist, or psychologist determines for the college that the disclosure is likely to have an adverse effect on the person, in which case the information shall be released to a physician, psychiatrist, or psychologist who is designated by the person or by his legal guardian.

(5) Provide copies of personal information to the person upon request. Charge a fee of twenty-five cents per page for copies of personal information.

(I) Disputes concerning information in system

(1) An individual may request, in writing, that the college investigate the status of personal information in a system that the individual believes is not accurate, relevant, timely, or complete.

(2) The college shall investigate the matter within a reasonable time but no later than ninety calendar days after the request has been made to determine if the information is accurate, relevant, timely and complete.

(3) The college shall notify the individual, in writing, of the results of the investigation and of the intended action of the college. The college shall delete any personal information that it cannot verify or that it finds to be inaccurate.

(4) If the individual is not satisfied with the college decision, the college may do either of the following:

(a) Permit the individual to include within the system, a brief statement of the individual's position on the disputed information. The college shall maintain a copy of the individual's statement in the individual's personnel or student file. The college may limit the statement to not more than one hundred words if the college assists the individual to write a clear summary of the dispute.

(b) The college shall include the statement in any subsequent transfer, report, or dissemination of the disputed information and may include with the statement of the individual a statement by the college that it has reasonable grounds to believe that the dispute is frivolous or irrelevant, and of the reasons for its belief.

(c) The college shall, at the written request of the individual, furnish notification that the disputed information has been deleted, or furnish a copy of the individual's statement of the dispute, to any person specifically designated by the individual. (The college shall clearly and conspicuously disclose to the individual the individual's right to make such a request.)

(J) The college shall comply with all applicable provisions of chapter 1347. of the Revised Code, whether or not explicitly set forth in this policy.

(K) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the implementation of this policy.

Chapter 3354:1-44 Background Check Policy

Ohio Adm.Code 3354:1-44-01 Background check policy.

(A) Purpose.

(1) The college is committed to providing a safe environment for all students and employees and endeavors to protect the health, welfare and safety of all students, employees and visitors on our campus. The background check process is intended to assist human resources and hiring managers or departments in the evaluation of whether a candidate is suitable for a position. As such, the college will conduct pre-employment background checks for all final applicants selected for employment for any kind, as well as all volunteers and work study participants.

(2) This policy shall apply, without limitation, to all individuals selected during the hiring process for full-time and part-time administrators, faculty, contract professional and staff positions.

(3) The college desires to promote fair and consistent methods to obtain, analyze, apply and retain information on final candidate background checks.

(B) Conducting background checks.

(1) Background checks will be performed by the college's human resources department once a final candidate has been selected for an offer of employment, but before the commencement of employment.

(2) Conditional offers of employment will be made subject to the successful completion of a criminal background check.

(3) Information obtained from the criminal background check will be used as part of the employment process and will be kept strictly confidential to the extent permitted under Ohio law.

(C) The president or the president's designee shall take all steps necessary and appropriate for the effective implementation of this policy.

Chapter 3354:1-50 Policies on Public Affairs, Safety and Security and Technology Resources

Ohio Adm.Code 3354:1-50-03 Public affairs and information policy.

(A) The office of public affairs and information shall be the primary liaison between the college and the community and shall be responsible for supporting the college's mission, programs and image.

(B) The office of public affairs and information shall be responsible for communicating to the public through all available media to ensure that the community has a positive image of the college, and that positions and statements of the college are presented accurately and consistently.

(C) The office of public affairs and information shall maintain a department manual detailing all responsibilities for the development and implementation of their marketing, communication services and public/community relations duties.

(D) The president or the president's designee is hereby directed to take all steps necessary and appropriate for effective implementation of this policy.

Ohio Adm.Code 3354:1-50-04 Safety and security policy.

(A) The department of campus police and security services shall take reasonable steps to maintain a safe and secure environment at college facilities.

(B) Manual of directives. The department shall maintain and operate in accordance with its "Department of Campus Police and Security Services Manual of Directives," in such form as that manual may be updated from time-to-time. (If the manual should happen to conflict with this safety and security policy, now or in the future, the terms of this policy shall govern.)

(C) Firearms and other weapons. Except as set forth in this policy, no person may carry or use weapons on college property. For the purposes of this policy, weapons are defined to be guns, knives, or any other dangerous instrument.

(1) The college's campus police and security services law enforcement officers, acting within the scope of their employment, may carry and use weapons on college property.

(2) Weapons may be used for educational purposes within college-approved curriculum, including without limitation the police and security training academy and criminal justice institute.

(3) Individuals (other than campus police and security services law enforcement officers) who bring weapons onto college property for educational purposes may do so only after first obtaining a permit for each such weapon from the department of campus police and security services. Such permits shall be limited to such times and locations as may be reasonably necessary to support educational purposes.

(D) Traffic and parking. The department of campus police and security services shall establish and enforce traffic and parking regulations for college facilities.

(E) Volunteer auxiliary police. The department of campus police and security services may appoint police academy graduates as volunteer auxiliary police, on an as-needed basis, and subject to the requirements of section 3345.04 of the Revised Code.

(F) The president or the president's designee is hereby directed to take all steps necessary and appropriate for effective implementation of this policy.

Ohio Adm.Code 3354:1-50-05 Technology resources policy.

(A) The college shall operate and maintain audio-visual, computing, copying, faxing, internet, knowledge management, networking, scanning, software, telecommunications, television, and similar resources to facilitate achievement of the missions and goals of the college. These college-operated and maintained resources, including all files, data and other information they may contain, are often referred to as "Technology Resources" in the policies and procedures of the college.

(B) The college routinely grants faculty, students, staff, and certain guests access to technology resources. Technology resources are generally the property of the college. Access to these resources is a privilege, but is not a right; access may be denied at any time without notice. Every technology resource user (each, a "User") is subject to this policy and to other applicable policies and procedures of the college.

(C) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the effective implementation of this policy.

Ohio Adm.Code 3354:1-50-05.1 Technology resources procedure.

(A) User access.

The college operates and maintains technology resources to facilitate achievement of its missions and goals. Access to technology resources is a privilege granted to users, but is not a right. Access may be denied, and technology resources may be seized, at any time and without notice. Every user is subject to this procedure, and other applicable policies and procedures of the college.

(B) Prohibited user behavior.

(1) Using technology resources to violate, or while violating, any law or college policy or procedure.

(2) Accessing or attempting to access any technology resource without proper authorization from the technology systems and resources ("TSR") department; or using any technology resource to access or attempt to access any other party's technology resource without proper authorization.

(3) Using technology resources to access, display, transmit, or store obscene or pornographic materials or communications.

(4) Interfering or attempting to interfere with the operation of any technology resource, or with any user's use or access.

(5) Sharing without prior TSR authorization any username, password, or other access security method; or using or facilitating the use of any technology resource that is subject to any access restriction without prior TSR authorization.

(6) Using any technology resource to send any communication using a false name, or using any other method that suggests another individual is the sender.

(7) Using any technology resource in a manner inconsistent with contractual obligations or other legal restrictions applicable to the college.

(8) Using technology resources in such a way as to appear to express the views of the college (except to the extent one is properly authorized to do so).

(9) Knowingly or intentionally introducing any bugs, viruses, worms, or other "malicious software" to technology resources; or knowingly or intentionally using technology resources to propagate any bugs, viruses, worms, or other "malicious software."

(C) No expectation of privacy.

Users should not have an expectation of privacy in anything they create, store, send, or receive using technology resources. Users should be aware that communications and other information sent or received through technology resources may not remain confidential while in transit or while stored on the sending or receiving technology resources. The college reserves the right, with or without notice, to monitor, access, and record all user activities involving technology resources.

The college monitors and records all user internet activity. Periodically, this activity is analyzed for individuals' violations of college policies and procedures. (At any time, users may obtain a list of internet activity associated with their account by submitting a request to the vice president of TSR.) The normal operation and maintenance of technology resources generally includes the backup and caching of data and communications, the logging of activity, the monitoring of general usage patterns, and other activities.

The college may also specifically monitor and record the activity and accounts of individual users of technology resources, including individual login sessions, communications, and any other activities, without notice, when (1) the user has voluntarily made them accessible to the public, as by posting to usenet or a web page; (2) it reasonably appears necessary to do so to protect the integrity, security, or functionality of college or other technology resources or to protect the college from liability; (3) reasonable cause exists supporting the belief that the user has violated, or is violating, college policy or procedure; (4) a user account appears to be engaged in unusual or unusually excessive activity, as indicated by the monitoring of general activity and usage patterns; or (5) when such monitoring or recording is otherwise required or permitted by law. Individually-targeted monitoring described in this paragraph must be authorized in advance by the vice president of TSR, vice president of human resources, or the college president.

The college, in its discretion, may disclose the results of any such general or individual monitoring, including the contents and records of individual communications, to appropriate college personnel or law enforcement agencies and may use those results in appropriate college disciplinary proceedings. Communications and other information transmitted or stored using technology resources may also be subject to disclosure under Ohio's public records laws.

(D) Installation of software and connection of devices.

Only TSR may install software on technology resources, or connect any device to technology resources. Any user who connects a device or installs software in violation of the foregoing does so at the user's own risk, and the college may hold such users responsible for any associated costs, claims, losses, or liabilities. Devices connected or software installed by anyone other than TSR will not be supported by the college, and may be removed by the college at any time without notice and without any liability for any damages whatsoever to any party.

(E) Violations.

Violation of this procedure may result in sanctions up to and including: immediate and permanent termination of access privileges; and civil or criminal legal action by the college, law enforcement organizations, and injured third parties. In addition, students, faculty, and staff may be subject to disciplinary actions described in other applicable College policies and procedures.

(F) Notices and disclaimers.

(1) The college may restrict or terminate user access at any time, without notice, and with or without any reason.

(2) Users are solely responsible for backing up their own files. Failure to do so may result in damage or complete loss of files and all associated information.

(3) The college disclaims any and all representations or warranties, expressed or implied, about the technology resources' quality; effectiveness; safety; fitness for any purpose; and lack of errors, viruses, worms, or other "malicious software."

(4) The college is not responsible for offensive or illegal material which may be accidentally or intentionally sent, received, or displayed while using computers or networks belonging to the institution.

(5) The college is not responsible for damaged, lost, unavailable or stolen data, intellectual property, or other real property resulting from or occurring while using technology resources.

(6) The availability of technology resources is not guaranteed to any extent whatsoever.

(7) Technology resources sometimes link to or contain materials generated or posted by college departments, organizations, students, employees, or others. Such materials do not necessarily represent the official views of the college.

(8) The college does not assume any responsibility or risk for user's use of the internet. The college does not operate, control or endorse any information, products or services on the internet in any way.

(9) Users should avoid personal uses of technology resources that result in any charge to the college. Users must promptly identify all such charges to the college, and promptly provide full reimbursement.

(G) Capitalized terms not defined in this procedure shall have the meaning given to them in the technology resource policy.

(H) The college president hereby designates the executive vice president of Administration or that person's designee to take all steps necessary and appropriate for implementing this procedure.

Ohio Adm.Code 3354:1-50-06 Youth Protection Policy.

(A) The college recognizes the critical importance of protecting young people who participate in its programs. The college shall:

(1) Establish and implement detailed procedures to screen all faculty, staff, volunteers, and subcontractors who are involved in programs involving youth.

(2) Provide training to all faculty, staff, volunteers, and subcontractors who are involved in programs involving youth including, but not limited to, college code of conduct, recognizing signs of suspected child abuse, and bullying prevention.

(3) Carefully supervise staff, young participants, programs/activities, and facilities in order to foster a safe environment.

(4) Develop and implement rules and regulations surrounding out-of-program contact that support the safety of the youth.

(5) Report suspected abuse in accordance with state and federal regulations.

(B) The president or the president's designee is hereby directed to take all steps necessary and appropriate for the implementation of this policy.
