NAC Chapter 62G — Rehabilitation of Delinquent Children

NAC 62G.010 Definitions.

As used in this chapter, unless the context otherwise requires, the words and terms defined in NAC 62G.020 to 62G.060, inclusive, have the meanings ascribed to them in those sections.

NAC 62G.020 “Department” defined.

“Department” means the Department of Health and Human Services.

NAC 62G.030 “Director” defined.

“Director” means the Director of the Department or any officer of the Department the Director designates to carry out, in whole or in part, the provisions of this chapter.

NAC 62G.040 “Juvenile court” defined.

“Juvenile court” has the meaning ascribed to it in NRS 62A.180.

NAC 62G.050 “Juvenile institution” defined.

“Juvenile institution” means the Nevada Youth Training Center or the Caliente Youth Center.

NAC 62G.060 “Special supervision program” defined.

“Special supervision program” has the meaning ascribed to it in NRS 62G.400.

NAC 62G.070 Application to participate.

1. An application to participate under NRS 62G.400 to 62G.470, inclusive, must be prepared by the appropriate county official and bear the endorsement of the district judge and the approval of the county commissioners.

2. The application must contain, but need not be limited to, the following information:

(a) The estimated number of offenders to be included in the program.

(b) The number of members of the staff to be included in the program, including the job description, the qualifications and the salary range for each position.

(c) The name and mailing address of the county official to whom checks must be mailed. If the check is to be made out to a person other than the county treasurer, the name and title of that person must be stated.

(d) A statement of assurance that the county or any of its agents will not, in the operation or administration of the approved program, refuse or deny admission to, employment in, or otherwise deny participation in the program on the grounds of race, creed, color or national origin.

(e) The location of the components of the program.

(f) The name and address of the person responsible for the administration of the program.

(g) A narrative statement describing the proposed program in detail and a proposed budget of expenditures.

(h) A statement signed by the responsible county official assuring that the money provided by the State will not be used to replace local money for existing programs for delinquent youth.

NAC 62G.080 Approval or denial of application.

1. Within 30 days after the receipt of an application, the Director will notify the applicant in writing of his or her decision to approve or deny the application.

2. If any part of the proposed program is denied, a detailed written explanation will accompany the notice, outlining the reasons for the denial.

NAC 62G.090 Revision of programs.

1. An approved special supervision program may be revised at any time during the period of the program upon written application to the Director.

2. Within 15 days after the receipt of an application for the revision of a program, the Director will approve or disapprove the application in writing.

3. Any change in a program will not be funded by state money until written approval has been obtained.

NAC 62G.100 Distribution of money.

Upon final approval by the Director of a special supervision program and budget for any juvenile court, the Department will forward to the county official named in the application the quarterly amount requested in the application. The final quarterly payment will be the amount requested less any anticipated surplus in the approved budget.

NAC 62G.110 Establishment of special supervision program in districts with population of more than 100,000.

If a special supervision program is established in a judicial district with a population of more than 100,000, a separate and identifiable program must be established. The activities of this program must be confined to working with eligible participants.

NAC 62G.120 Eligible participants in districts with population of more than 100,000.

In judicial districts with a population of more than 100,000, a majority of the participants in a special supervision program must have been adjudicated delinquent and must have been given a suspended sentence for attendance in a juvenile institution.

NAC 62G.130 Case histories.

A case history must be maintained for each participant in a special supervision program. The case history must contain a plan of rehabilitation with identifiable goals.

NAC 62G.140 Length of participation.

Every effort must be made to keep participants in a special supervision program no longer than is necessary.

NAC 62G.150 Supporting services.

1. Expenditures for supporting services may be approved for a special supervision program. Such services include, but are not limited to:

(a) Special contracts for psychiatric, psychological, medical, dental, employment and recreational services.

(b) The provision of alternate living accommodations.

(c) Employment counseling and testing.

(d) Direct financial assistance.

2. Each proposal for supporting services will be given individual consideration.

3. The purchase of supporting services from other governmental agencies will be allowed only upon the specific approval of the Director.

NAC 62G.160 Approved expenditures.

The following expenditures will be approved for a special supervision program:

1. The salaries or wages, including related benefit costs applicable to other county employees, of employees involved in the program. The salaries of other county administrative personnel will not be approved except under unusual circumstances.

2. In extreme cases, the purchase of major items of equipment. In each case, a detailed justification is required. Money for the construction, maintenance or operation of existing county juvenile facilities will not be approved.

3. Training for personnel in the program.

4. Expenses for operating supplies, communication costs and rental of space directly related to the program.

NAC 62G.170 Disbursement of unallocated money.

If a juvenile court does not apply for any money under the provisions of NRS 62G.400 to 62G.470, inclusive, or an approved program does not require the full funding as appropriated, the Director may disburse the unallocated money in the following manner:

1. Participating juvenile courts will be advised of the total amount of money available for disbursement.

2. Supplemental applications for additional money will be accepted by the Department.

3. In the disbursement of unallocated money, priority will be given to those judicial districts whose boundaries include two or more counties. For the purposes of this section, Carson City is considered a county.

NAC 62G.180 Reversion of money; final audit.

1. Any money appropriated pursuant to NRS 62G.400 to 62G.470, inclusive, is for the fiscal year beginning on July 1 and ending on June 30.

2. Any money not expended or legally obligated during this period reverts to the State Treasurer.

3. A final audit for the fiscal year must be provided to the Director within 90 days following the end of the fiscal year.

NAC 62G.190 Contents of reports.

1. The Director may prescribe the form for a report made pursuant to NRS 62G.470.

2. The report must contain information measuring the success of a special supervision program in relation to:

(a) The reduction in the number of offenders committed to juvenile institutions.

(b) The behavioral and attitudinal changes of offenders assigned to the program.

(c) Changes in the nature and frequency of offenses committed by offenders assigned to the program.

NAC 62G.200 Reviews; audits.

1. A review of special supervision programs will be made at least once each year by the staff of the Department and at such other times as the Director may require.

2. This review will be made in cooperation with county officials who are responsible for the administration of the programs.

3. The review will be made to verify that the proposed plans previously approved by the Director are in fact the programs being provided by the court and that these programs meet the intent of the law.

4. The review will include fiscal audits as well as program audits to ensure compliance with this chapter and NRS 62G.400 to 62G.470, inclusive.
