1.History. The 1977 legislative assembly enacted the "Edible Bean Industry Promotion Act", codified as North Dakota Century Code chapter 4-10.3, and created the edible bean council.

2.Council membership. The council consists of five members, each member being elected from one of the edible bean districts. A chairman, who also must be a member of the council, is elected by a majority vote of the council. In addition to the five council members, the commissioner of agriculture is an ex officio member of the council.

3.Council meetings. All meetings of the council are called by the chairman, except special meetings which are called by the chairman on the petition of three council members within seven days after the receipt of the petition by the chairman.

Chapter 21-02-01 General Provisions

This article is promulgated pursuant to North Dakota Century Code chapter 4-10.3 and section

N.D. Admin. Code 28-32-02 This article applies to all edible beans grown in North Dakota or sold to a designated handler and shall be applied in conjunction with North Dakota Century Code chapter 4-10.3

Chapter 21-02-02 Reporting Requirements

N.D. Admin. Code 21-02-02-01 Statutory definitions

Unless otherwise defined, or made inappropriate by context, all words used in this chapter have meanings given to them under North Dakota Century Code chapter 4-10.3.

N.D. Admin. Code 21-02-02-02 Definition of designated handler

"Designated handler" shall, for the purposes of the assessment and reporting required by the North Dakota Century Code chapter 4-10.3, include a grower selling the grower's unharvested edible beans out of state, or delivering the grower's edible beans from the farm on which they are produced to any storage facility, packaging shed, or processing plant located outside the state.

N.D. Admin. Code 21-02-02-03 Reports - Form - Contents - Filing requirements

Every designated handler shall, within thirty days after the end of each calendar quarter, file a quarterly edible bean promotion report including the remittance of assessment fees for that quarter, with the council in the form, and containing such information, as prescribed by the council. The calendar quarter shall end on March thirty-first, June thirtieth, September thirtieth, and December thirty-first of every year.

N.D. Admin. Code 21-02-02-04 Requests for refunds - Filing requirements

A grower wishing to obtain a refund of any assessment paid to the edible bean fund shall apply to the council for a refund application blank within sixty days after such assessment or final settlement is paid to a designated handler. The completed application blank shall be returned to the council within sixty days from the date it was mailed to the grower.
