2 CAR § 197-101 Application {#sec-2-car-197-101 omnilex-key=us-ar-regs-official--title-2-part-197--2 CAR § 197-101}

2 CAR § 197-101. Application.

(a) Applicants desiring permits for quarantined feedlots in Arkansas shall make written application to the Arkansas Board of Animal Health and the United States Animal and Plant Health Inspection Service, Veterinary Services Division of the United States Department of Agriculture on prescribed application form which shall be furnished by the board.

(b) The application shall be deemed to be the applicant’s full consent and agreement to comply with the definition of quarantined feedlots according to 9 C.F.R. § 78.1 and the procedures and rules established herein governing such feedlots.

(c) Such application shall contain the legal description and the location of the quarantined feedlot.

2 CAR § 197-102. Permits.

(a) Upon approval of such application, a quarantined feedlot permit, bearing a permit number, shall be issued by the Arkansas Board of Animal Health to the person signing the application who in turn shall be held as the party responsible for compliance with this part.

(b) Such permit shall be issued on a yearly basis beginning July 1, and must be renewed annually.

(c) Application for renewal of permit must be made to the board prior to July 1 for the following year.

2 CAR § 197-103. Compliance.

(a) Cattle moving interstate and intrastate must meet the existing federal regulations and state rules at the time of movement to the approved quarantined feedlot.

(b) Quarantined feedlot operator permits may be revoked by the Arkansas Board of Animal Health upon violation of state rules or federal regulations.

2 CAR § 197-104. Out-of-state shipments.

Out-of-state shipments of cattle to an Arkansas quarantined feedlot must enter Arkansas on a completed official health certificate or a 1-27 permit issued by an accredited veterinarian indicating the official feedlot permit number assigned.

2 CAR § 197-105. Quarantine.

(a) Cattle shall be quarantined to such quarantined feedlot as described in the operator's application.

(b) All cattle except steers and spayed heifers leaving such feedlot:

(1) Must go directly to slaughter;

(2) May be moved directly to another quarantined feedlot with a permit from the state animal health official; or

(3) May be "S" branded at the feedlot and move to a market to be sold for movement with a 1-27 permit issued at the market directly to another quarantined feedlot or directly to slaughter.

Authorized representatives of the Arkansas Board of Animal Health and/or the Animal and Plant Health Inspection Service, Veterinary Services of the United States Department of Agriculture shall make periodic inspection of approved quarantined feedlots as they may deem necessary.

In the event of death of an animal while still in quarantine, prompt and proper disposition of said animal shall be made by the feedlot operator.

Each animal moved to and all bovine animals confined (including calves) in an approved quarantined feedlot shall be permanently identified by an "S" shaped permanent "hot", "fire", or "freeze" brand (not acid or caustic) not less than three inches (3”) applied to the left side of the jaw at point of origin and/or time of consignment to the feedlot identifying the animal as a quarantined feedlot animal and under quarantine at location described in the application until released to go to slaughter or to another quarantined feedlot with a permit from the state animal health official, or may be "S" branded at the feedlot and move to a market directly to another quarantined feedlot or directly to slaughter.

2 CAR § 197-109. Revocation.

(a) If a permit for the maintenance of a feedlot is relinquished by the permit holder or if revoked by the Arkansas Board of Animal Health or the United States Department of Agriculture, Animal and Plant Health Inspection Service, such premises shall be under quarantine until all cattle have been removed by consignment to slaughter, or may be moved directly to another quarantined feedlot with a permit from the state animal health official, or may be "S" branded at the feedlot and moved to a market to be sold for movement with a 1-27 permit issued at the market directly to another quarantined feedlot or directly to slaughter.

(b) All cattle must be removed within three (3) months.

2 CAR § 197-110. Records.

(a) Quarantined feedlot operators shall maintain permanent records for a period of three (3) years after sale date of animal, such records to consist of:

(1) Number of livestock purchased, from whom purchased, and date of purchase;

(2) Number of cattle moved from quarantined feedlot, date moved, and location to which moved; and

(3) Dates and number of losses by death.

(b) All records shall be open and subject to inspection by authorized representatives of the Arkansas Board of Animal Health and/or the United States Department of Agriculture, Animal and Plant Health Inspection Service, Veterinary Services.
