Ala. Admin. Code r. 482-2-101-.02 Adoption Of International Fire Code® (2021 Ed.); Exceptions.

(1) Except as specifically provided in paragraph (2), the 2021 edition of the International Fire Code® and Appendices B, C, D, E, and M, as promulgated by the International Code Council®, are adopted by reference as a regulation of the State Fire Marshal. Said code shall be used for projects on which the date of the architectural services contract is on or after the effective date of this rule as revised.

(2) The following portions of the 2021 edition of the International Fire Code® are not adopted:

(a) Part 2 of Chapter 1 (“Administration and Enforcement”).

(b) Appendix A.

(c) Section D107 of Appendix D is not adopted but is recommended.

(d) Appendix F.

(e) Appendix G.

(f) Appendix H.

(g) Appendix I.

(h) Appendix J.

(i) Appendix K.

(j) Appendix L.

(k) § 1103.5.4 and Appendix M are not adopted but are recommended.

Ala. Admin. Code r. 482-2-101-.04 Severability; Conflict With State Statutes Or Laws

(1) The provisions of this chapter are severable. If any provision or the application thereof to any person or circumstance is held invalid for any reason, the invalidity shall not affect the other provisions or any other application of this chapter which can be given effect without the invalid provisions or application.

(2) Any portion of any code adopted in this chapter which conflicts with Alabama statutes or law will be interpreted, applied, or enforced so as to conform with such statutes or law if practicable, or will be deemed null and void only to the extent of such conflict if conflict cannot be avoided. Invalidity of a portion of an adopted code due to conflict with Alabama statutes or law shall not affect the validity of the remainder of the code.

Ala. Admin. Code r. 482-2-101-.05 Use Of Later Code Editions

In his discretion and upon request in connection with particular projects, the State Fire Marshal may allow use of later editions of fire or building codes promulgated by the International Code Council® than those specified in this chapter.

Ala. Admin. Code r. 482-2-101-.06 Use Of Other Codes

(1) In order to better perform the statutory duties and responsibilities of the office of State Fire Marshal, portions of the 2021 editions of the following codes promulgated by the International Code Council® or the National Fire Protection Association may be consulted by the office of State Fire Marshal as needed to determine the proper applicability of the codes adopted by reference in the Rule 482-2-101-.02 to any structure or building:

(a) International Building Code®.

(b) International Fuel Gas Code®.

(c) International Mechanical Code®.

(d) International Existing Buildings Code®.

(e) International Plumbing Code®.

(f) National Fire Codes®.

(2) This rule does not purport to adopt the codes listed in paragraph (1). Instead, it is intended to state that said codes may be consulted as necessary to determine whether the fire prevention and protection aspects of the codes that are adopted by reference in Rules 482-2-101-.02 are properly applied under the circumstances.

Ala. Admin. Code r. 482-2-101-.07 Inspection And Copying Of Codes Described In This Chapter

The State Fire Marshal's office should be contacted about inspection of any code referenced in this chapter and, if so contacted, shall arrange for such inspection on-1ine. On request, the State Fire Marshal's office shall furnish information about the purchase of any of the codes referenced in this chapter. Printing of codes or portions thereof by the State Fire Marshal's office shall be at the cost of the per page fees for copying set out in Code of Ala. 1975, §27-4-2(a)(12).
