On order of the Court, the application for leave to appeal the July 8, 2025 judgment
of the Court of Appeals is considered. We direct the Clerk to schedule oral argument on
the application. MCR 7.305(I)(1). The parties shall file supplemental briefs in accordance
with MCR 7.312(E), addressing: (1) whether the trial court abused its discretion in
concluding that plaintiffs’ expert testimony with respect to the standard of care was
sufficiently reliable under MRE 702 and MCL 600.2955; (2) whether the Court of Appeals’
decision conflicts with Danhoff v Fahim, 513 Mich 427 (2024); and (3) whether the Court
of Appeals erred by not considering plaintiffs’ alternative theory of liability.
Amici who appeared at the application stage are invited to file supplemental briefs
amicus curiae. Other persons or groups interested in the determination of the issues
presented in this case who are not exempt from the motion requirement under MCR
7.312(H) may move the Court for permission to file briefs amicus curiae.
