PEOPLE OF THE STATE OF MICHIGAN,
Plaintiff-Appellee,
v
CHRISTOPHER SCOTT MARLINK,
Defendant-Appellant.
___________________________________________
On order of the Court, the application for leave to appeal the October 13, 2025 order
of the Court of Appeals is considered. We DIRECT the plaintiff to answer the application
for leave to appeal within 28 days after the date of this order. In addition to the issues
raised in the defendant’s application, the plaintiff shall address: (1) whether the motion to
vacate the order of appointment filed by the defendant’s appellate counsel satisfied the
requirements of Anders v California, 386 US 738, 744 (1967); (2) whether the defendant
received sufficient time “to raise any points that he chooses” in response to appellate
counsel’s motion, see id.; (3) whether the trial court made a finding that the appeal was
“wholly frivolous” after “a full examination of all the proceedings,” see id.; and (4) whether
any deviation from the Anders procedure resulted in the defendant being “denied the right
to appellate review or the appointment of appellate counsel” for purposes of MCR 6.428.
The application for leave to appeal remains pending.
