On the Court’s own motion, we REMAND this matter to the trial court for appellant to
move to clarify the record with regard to whether appellant intended to pursue an appeal as to all four
children discussed in his brief on appeal and, relatedly, why a claim of appeal was not filed from the order
of termination in Case No. 21-001719-NA. The proceedings on remand are limited to this issue. We
retain jurisdiction.
Appellant shall initiate the proceedings on remand within 14 days of the date of this order.
Appellant shall file with this Court a copy of any motion and supporting brief filed in the trial court, and
appellant shall file a copy of any order entered within 14 days after entry. The trial court shall hear and
decide the matter within 35 days of the date of this order and shall make an appropriate determination on
the record. The trial court shall order a transcript of any hearing on remand to be prepared at public
expense and filed within 21 days after completion of the proceedings.
If the trial court concludes that appellant intended, at the time he signed the request for
counsel as to the other three children, to also pursue an appeal as to the fourth child, the trial court shall
appoint appellate counsel for appellant and shall otherwise ensure that a claim of appeal is filed on behalf
of appellant in Case No. 21-001719-NA. The Court of Appeals will accept the claim as timely filed.
Current appellate counsel Hugh R. Marshall (P 48269) may represent appellant in both appeals if the trial
court determines that such representation is appropriate.
