Court of Appeals, State of Michigan
ORDER

Docket No. 380663
LC No. 25-013834-CZ

The motion to waive fees is GRANTED for this case only.
The complaint for superintending control is DENIED.
The motions to “consolidate cases and disqualify respondents” and to “disqualify respondent
Hughes and stay proceedings” are DENIED.
On the Court’s own motion pursuant to MCR 7.216(C)(3), we conclude that plaintiff has
“habitually, persistently, and without reasonable cause” engaged in vexatious conduct in this Court. This Court
entered an order on May 11, 2026, which explained plaintiff’s history of failing to comply with the Court Rules
despite several communications from this Court explaining the deficiencies in his filings, referring plaintiff to
the applicable Court Rules, and directing him to this Court’s guides for parties proceeding without attorneys,
which exist to provide plain-language assistance to filers in understanding the Court Rules and this Court’s
procedures. The order also explained that plaintiff has a history of filing meritless appeals and original actions
in this Court. Plaintiff nonetheless continued to file nonconforming and meritless pleadings, resulting in a
warning from this Court that he risked being deemed a vexatious litigator under MCR 7.216(C). In re Burgess,
unpublished order of the Court of Appeals, entered May 11, 2026 (Docket No. 380623). Despite this warning,
plaintiff continued to file further nonconforming and meritless pleadings in this Court, including the present
complaint for superintending control, as well as in Docket Nos. 380623 and 380636. As a result of plaintiff’s
repeated vexatious conduct, we direct that, in any non-criminal case, plaintiff is prohibited from “continuing
or instituting legal proceedings in [this] Court without first obtaining leave . . .” MCR 7.216(C)(3). Upon the
Clerk’s certification of this order, any future filings by plaintiff in any non-criminal case must include a request
for leave to file them and an affidavit in which plaintiff certifies that his proposed filing is not frivolous, has
not been made in bad faith, and is well-grounded in fact.
