The motion to dismiss this appeal is DENIED because the moving appellees have not
established that this Court lacks jurisdiction over this appeal as of right. The motion includes no citation
to legal authority, and it appears possible that the moving appellees have failed to recognize that
jurisdiction over an appeal of right in this probate court trust proceeding case is governed by MCR
5.801(A). See, e.g., Houghton v Keller, 256 Mich App 336, 339; 662 NW2d 854 (2003) (indicating party
“may not merely announce his position and leave it to this Court to discover and rationalize the basis for
his claims” or “give issues cursory treatment with little or no citation of supporting authority”). Also, at
minimum, it appears at least arguable that the aspect of the November 25, 2025 order appealed from
imposing sanctions on appellant may qualify as an order appealable of right under MCR 5.801(A)(5) as
an order that “otherwise affects with finality the rights or interests of a party or an interested person in the
subject matter.” This order is without prejudice to further consideration of this Court’s jurisdiction over
this appeal of right by the case call panel.
