Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The claim of appeal is PARTIALLY DISMISSED for lack of jurisdiction over any order
entered after October 27, 2025. The time for filing an appeal of right is jurisdictional, and the 21-day time
period for filing a claim of appeal “runs from the entry of” the order being appealed. MCR 7.204(A)(1)
(emphasis added). “[E]ntry means the date a judgment or order is signed or the date that data entry of the
judgment or order is accomplished in the issuing tribunal’s register of actions.” MCR 7.204(A). The
claim of appeal was timely filed within 21 days from the entry of the October 14, 2025 order. However,
when the claim of appeal was filed on October 27, 2025, an order amending the October 14, 2025 order
was not yet entered and the time for filing a claim of appeal from the amending order had not started to
run. MCR 7.204(A)(1). Therefore, the claim of appeal was premature from, and this Court lacks
jurisdiction over, such an order. This appeal continues as a claim of appeal from the October 14, 2025
order only.
