Court of Appeals, State of Michigan
ORDER
IN RE CONTEMPT OF DJK
Docket No. 381716
LC No. 2026-071919-PP
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction. The time for filing an appeal
of right is jurisdictional, MCR 7.204(A), and the claim of appeal was not timely filed. MCR 7.204(A)(2).
It was not filed within 42 days after entry of the May 29, 2026 criminal contempt order, MCR
7.204(A)(2)(c); rather, it was filed 55 days after entry of that order. It also was not filed within 42 days
“after entry of an order” denying a timely request for counsel, MCR 7.204(A)(2)(b) (emphasis added),
because an order denying the appointment of counsel was not entered in the case. Finally, the claim of
appeal was prematurely filed before entry of the order granting the request for counsel; it was not filed in
accordance with MCR 6.425(G). MCR 7.204(A)(2)(a). Dismissal is without prejudice to whatever other
relief may be available consistent with the rules.
