ORDER
JOHNSON LAW PLC V FREMONT INSURANCE COMPANY
Docket No. 379559
LC No. 24-120314-CB

The motion for stay pending appeal is DENIED. This order does not evince a waiver of
defendants’ attorney-client privilege. Absent a true waiver, involuntary disclosure only eliminates the
security against publication; privileged documents otherwise retain their privileged status. See Leibel v
Gen Motors Corp, 250 Mich App 229, 242-243; 646 NW2d 179 (2002). Contrary to defendants’
arguments, denying the requested stay does not moot the privilege issues in this case as the question
remains whether defendants have the right to control the introduction of information into evidence. See
Franzel v Kerr Mfg Co, 234 Mich App 600, 616; 600 NW2d 66 (1999).
