Court of Appeals, State of Michigan
ORDER
JAMES HARTZLER V S&O MANAGEMENT PARTNERS LLC
Docket No. 381121
LC No. 23-006401-CB
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction because, assuming without
deciding that the March 27, 2026 order was final, the claim of appeal was not timely filed. MCR
7.204(A)(1). For purposes of subrule MCR 7.204(A)(1) “ ‘entry’ means the date a judgment or order is
signed or the date that data entry of the judgment or order is accomplished in the issuing tribunal’s register
of actions.” The March 27, 2026 order appealed from was signed and entered on the register of actions
on March 27, 2026. The claim of appeal was not filed within 21 days of March 27, 2026, and the motion
for postjudgment relief was also not filed within the initial 21-day appeal period from entry of the order
or within further time allowed by the trial court for good cause during that initial 21-day period. MCR
7.204(A)(1). In fact, the motion for reconsideration was filed on April 20, 2026, 24 days after entry of
the March 27, 2026 order. Therefore, the claim of appeal could not be timed from entry of the order
denying reconsideration. MCR 7.204(A)(1)(d). Appellants’ delayed application for leave to appeal
remains pending in Docket No. 381107.
