Court of Appeals, State of Michigan
ORDER
KIMBERLY HOLT V EVELYN HARRIS
Docket No. 378487
LC No. 23-013930-CH
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction because it was not timely filed.
MCR 7.204(A). The final order in this case was entered on August 5, 2025 and the trial court denied a
timely postjudgment motion on October 6, 2025. The appeal was not filed within 21 days of the October
6, 2025 order and is therefore untimely. Even assuming arguendo that the final order in this case was the
October 6, 2025 order, appellants’ supplementary motion following that order was not filed within the 21-
day appeal period set by MCR 7.204(A) Accordingly, because the claim of appeal was not filed within
21 days after entry of the final order and the motion for postjudgment relief was not filed within the initial
21-day appeal period or within further time allowed by the trial court, the claim of appeal was not timely
filed. MCR 7.204(A)(1). Dismissal is without prejudice to the filing of a late appeal under MCR
7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred.
