Court of Appeals, State of Michigan
ORDER
RYAN LITTLETON V FARMERS INSURANCE EXCHANGE
Docket No. 382013
LC No. 23-011538-NI
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The delayed application for leave to appeal is DISMISSED for lack of jurisdiction because
appellant failed to file the application within six months of the date of entry for the March 11, 2025 order
denying reconsideration of the February 14, 2025 order granting summary disposition as required by MCR
7.205(A)(4)(a). The Court further ASSESSES COSTS in the amount of $500 against attorney Jerard M.
Scanland (P74992) for having filed this application, which is clearly untimely and also does not conform
to the Court Rules. The application recognizes that it was filed 17 months after entry of the order denying
reconsideration, and nonetheless asserts that this Court has jurisdiction pursuant to “MCR 7.205(G)(3).”
MCR 7.205(G)(3) does not exist and has not existed for several years since MCR 7.205 was amended in
2021. Further, while the Court Rules once allowed the filing of a delayed application within 18 months
of the order appealed or an order denying a timely motion for reconsideration of the order appealed, that
has not been the case since November 1, 1995, when the period was shortened to 12 months. It was then
shortened to six months in 2011. Filing this application when it was clearly time-barred is frivolous and
has resulted in a waste of this Court’s time and resources. The Court further notes that Mr. Scanland has
a lengthy history of filing defective appeals in this Court spanning many years. Along with being filed
too late, this application was also filed without several items required by the Court Rules, including a
signed copy of the order appealed, transcripts, and proper service on opposing counsel—all defects that
have been identified in past appeals filed by attorney Scanland. The costs assessed by this order shall be
paid to the Clerk of this Court within 14 days of the Clerk’s certification of this Order. Such costs are
personal to the attorney and may not be charged back to the client.
