This Court’s June 3, 2026 opinion and order vacated the trial court’s best-interest
determination as to the oldest child and remanded this case to the trial court, while retaining jurisdiction,
for further consideration of the oldest child’s best interests.
On remand, the trial court entertained arguments from the respective parties and again
found that termination of respondent’s parental rights as to the oldest child was in the child’s best interests.
In doing so, the trial court explicitly considered the child’s placement with her father as a factor weighing
against termination of parental rights. See In re Olive/Metts Minors, 297 Mich App 35, 43; 823 NW2d
144 (2012). However, the trial court reasoned, that placement did not outweigh the “[b]ond, permanence,
stability and finality” factors that weighed in favor of the termination of parental rights. Therefore, the
trial court entered an order terminating respondent’s parental rights to the oldest child.
Having reviewed the record, we conclude that the trial court did not clearly err in its
findings of fact or otherwise err in its conclusions of law. See id. at 40-41. Therefore, we affirm the trial
court’s order terminating respondent’s parental rights to her oldest child. This appeal is now concluded.
We do not retain jurisdiction.
